The Haddonstone Pond was built in 1987 and was designed to drain into the Ozaukee County Drain Tile System by the then City Engineer, who reviewed and approved the pond construction drawings. The County Tile System has since collapsed or has become totally blocked, and is not draining the pond. This situation has existed since at least 1997, and at various times the Haddonstone Homeowners Association has notified City Officials of this situation, but no corrective action has been taken. The cost to repair the failed County Tile System should be borne by the City as a whole, not selected property owners because: 1. The decision to drain the Pond to the County Tile System was made by the then City Engineer 2. The City gaurenteed there would be no problems with the Haddonstone Pond handling the additional flow from the The Pines Pond when it was connected in 1996. 3. The Haddonstone has notified City Officials of pond drainage problems attributable to the County Tile System since at least 1997. 4. It is impossible to fairly and equitably determine who are the benefitted property owners of this project.
