Dominion Homes... Provide Snow Removal For Cloverbrook Farms Residents!

I recently spoke with Mr. Mike Archer who is the marketing and sales vice president for Dominion Homes. We spoke about snow removal on Dominion owned roads that are never get snow removal and/or treated for ice. Because Dominion Homes own the streets in question, the streets are viewed by the city as a private access/driveway that is simply open to the public. As a result, our streets are neglected and they're left snow and ice covered for days on end. Up until recent warm temperatures, our streets were without a doubt, dangerous and nearly impassible without four wheel drive capabilities, which still allowed for many difficulties.


Why? Because Dominion Homes (Mr. Archer), blatantly - after acknowledging and accepting both liability and responsibility - refuses to provide snow removal. Even after hearing the concerns of your customers and residents, the answer has remained the same, "...snow removal will NOT be provided simply for monetary reasons..."

---------Recent Email To Dominion Executives----------

I hope my email finds you all well and I apologize for escalating this issue to executive entities of Dominion Homes. I've tried repeatedly to get it resolved to no avail and this will be my last and final effort to get this issue resolved.

Let me first start off by saying how happy I have been with Dominion homes and the services offered by my sales representatives, construction managers and staff, in the past. Up until now, I haven't had any issues that were not able to be resolved.

The purpose of my email is to gain your attention and assistance into a looming matter, that according to Mr. Mike Archer, is the sole responsibility and at the discretion of Dominion Homes. Up until recently, nobody would accept responsibility for this issue until I spoke with Mr. Archer this morning. As it stands now, the residents of Cloverbrook Farms that are living in the active construction areas utilize streets which ultimately belong to Dominion Homes. Those streets are also being utilized to further the construction of new homes for Dominion and directly affect profits for the company. As a result of active construction, our streets do not have a finished surface and as stated before, still belong to Dominion homes. The rest of my community falls under the city public works division who does a great job cleaning and salting the roads.

Because Dominion Homes own the streets in question, the streets are viewed as a private access/driveway that is open to the public. As a result, our streets are neglected and left snow and ice covered for days on end. Up until recent warm temperatures, our streets were without a doubt, dangerous and nearly impassible without four wheel drive capabilities, which still allowed for many difficulties. Why? Because Dominion Homes (Mr. Archer), blatantly - after acknowledging and accepting both liability and responsibility - refuses to provide snow removal. Even after hearing the concerns of your customers and residents that point out obvious safety concerns and quality of life issues, the answer has remained the same, "...snow removal will NOT be provided simply for monetary reasons..."

We come to you all as a concerned citizens, loyal customers and first responders. There are a slew of safety issues by not adequately providing snow removal and treating Dominion Owned roads. Some of the issues involve a delayed response in the event there is a medical/fire/police emergency, the streets are impassable for emergency vehicles, and the risk of an accident is much higher. That's just to name a few and then there are simple quality of life issues. My neighbors and my family are unable to get out of our homes to go to the grocery store for food and other essential items unless conditions approve. Again, the list goes on.

We have addressed the issue up to the city of Shelbyville, Omni HOA, and Dominion homes. At this point, everyone agrees that the city of Shelbyville is not responsible for cleaning the roads because Dominion homes has not turned the streets over to the city yet. Then the finger-pointing continues between Dominion homes and Omni HOA, up until recently when I was told by Mr. Archer, "...well the finger pointing can stop, this is Dominion's call and decision..."

We've been told that this issue was brought up and a vote took place several years back. The residents voted down snow removal as a part of the HOA's responsibility. Mind you, we have lived in this community since July 2013 and were not able to participate in that vote. Furthermore, when 90% of the community is already being plowed and treated by the city public works, they would likely vote down the cost for snow removal because that doesn't directly affect them.

Then we were told by representatives of dominion that it was impossible to plow the streets because they did not have a finished surface. I will tell you that your Brookfield community in Louisville reaps the benefits of snow removal, even though the streets do not have a finished surface. I also acknowledge that snow removal is incorporated into the cost of their HOA dues because the city public works does not provide the services for snow removal. However, in Shelbyville, this is not the case. Once the street is handed over to Shelbyville, with a finished surface, the city does an excellent job staying on top of snow removal and keeping the streets safe.

After bringing this issue up and everyone agreeing that there is a legitimate concern for safety, still, nobody (including Dominion Homes and Mr. Archer) wants to step up and take responsibility for cleaning the streets that are still under construction and ultimately owned and controlled by Dominion homes.Every equation you apply to this situation always results with the liability and responsibility being that of Dominion homes. Our issues and concerns have been voiced and fallen on deaf ears. Also, the HOA representative, Linda Lang, has told us that she brought the issue up to representatives of Dominion and that there, "would be no snow removal."

Our frustration now comes because Dominion is worried about profit margins and spending, meanwhile, the customers of dominion and residents directly affected by this issue simply have to sit by and just deal with it.We are middle class families that still have to commute to and from work despite snowy and icy roads. We simply want Dominion homes to provide future snow and ice removal while we continue to share the road with the company. WE are the ones who are losing out here. OH, it's also important to point out that Louisville Paving Company was removing snow from various parts of the community yesterday, to include directly in front of Dominion's model home... why couldn't Dominion have them clean snow off of our roads...?

Because our concerns have been rationalized and Dominion Homes refuses to rectify this issue to a reasonable and acceptable resolve, we have no other option but to be creative and reach out to the media, Better Business Bureau, social media, YouTube, the newspaper, lawyers and anybody else who is willing to listen to us in order to raise awareness and attention to this issue. Several media outlets have already expressed interest in our story and now want us to forward them this email, our photos and our videos and our personal accounts, etc. As long as our families are at risk and adversely effected, WE will NOT back down until this issue is resolved acceptably. Dominion Homes would not profit or even exist if it weren't for hardworking families, like us, that are buying your homes. As one of the "top 25 builders in the US" we are disappointed and down right mad because Dominion has abandoned us and denied our call for help. Dominion holds they key here... the solution and remedy to this problem, yet Dominion refuses do what's right.

However, please know that it is our sole intent to work collectively with dominion homes in order to get future snow and ice removed and to ensure safe passage. Personally, Dominion has done right by me in the past. So much so that I have allowed dominion to show my beautiful home to potential new residents and complete strangers in order to close a sale. Furthermore, I have been quick to defend Dominion homes in the face of opposition by some of my neighbors. Up until now, I have had nothing bad to say about Dominion homes. So I would ask that you extend the same loyalty and commitment back to me, the residents and your customers that are directly affected by this and provide snow removal for the roads that are ultimately owned by Dominion homes.

Please know that this is my last ditch effort to get this issue resolved. Also know that I am speaking as a representative for all the residents that are directly involved and affected by this situation.I have told Mr. Archer that I would escalate this issue to they media and other avenues, and he seemed unconcerned and left me in the sense that I have to do what I have to do, so to speak. We would like to caution Dominion Homes and ask them to step up to the plate. My next email is much of the same, drafted and ready to send out. However, that email would be addressed to Dominion Executives with the following audience CC'd, including by not limited to: local and national media outlets, local attorneys, the city mayor and public works engineers, various government entities and will be publish to any/all social media outlets. Aside from raising attention, support and seeking a solution to this matter, this email is merely intended to be the final attempt to handle the issue "in house" and to avoid further escalation.

We appreciate any and all help that you can provide to make our community as safe as it possibly can be. I look forward to your reply.
