The current owner, Donald Ahern agreed to the terms and conditions of the convenants in writing on November 15, 1991.The property has been used as a dentist office for over 20 years. Therefore, rezoning should not be necessary for the purchase of this property or use as professional office space.

I was made aware of this petition this afternoon and just wanted to give all of you my contact information in case you have any questions. Mandy and I are looking forward to being good neighbors and friends with all of you. We live right down the street in Shellpoint and the last thing that we want to do is to change the Mount Pleasant that we all love.
The reason that we have requested the zoning request is because we are planning on purchasing the building from the Ahern's. Currently the property is zoned PD which would normally be fine for us to operate our dental office from but during our due diligence period we found out from the town the following...The quoted paragraphs below is a copy and paste directly from the town of Mount Pleasant:
"With Planned Development District (PD) zoning, there should be a document containing a zoning map and specifying permitted uses and development standards (such as lot sizes, building setbacks, height, etc.). The issue with the North Point neighborhood is that there is no PD document. As such, Town staff is unable to confirm what are the applicable zoning regulations.
I am aware of the existence of neighborhood covenants that allow for “professional office” uses at 1441 North Point Lane. However, covenants are not zoning; they are private agreements between two or more parties, and the Town is not typically one of those parties. As such, the Town has no legal authority to enforce covenants. The Town is, however, required by State law to cease processing any application if we are made aware that the application conflicts with recorded covenants. A property owner is required to abide by both zoning requirements and any recorded covenants."
The only reason we want to re-zone this property as office professional is to protect ourselves and our investment to make sure that we are legally operating per town and subdivision requirements.

I'm not sure why this property needs to be rezoned, if it is in fact, going to be a dentist office as in the past. I just don't want them to have the option of tearing down the existing property and have them build a multi-use concept.

I vote no for the rezoning request... let's avoid the unintendened negative consequences of rezoning or in the future, let the owner provide a better explanation for the requested change.

This neighborhood is a precious gem in Mount Pleasant. It would be a shame to see it changed by re-zoning.

Why is a re-zoning request without, supporting documentation or clear statement of intention, being considered. The application presented to the town is incomplete. The guidance provided by the town is confusing and has placed the protection of our neighborhood squarely on the homeowners. The request should be denied.

I see no reason to change the excellent vision that Harry Hitopoulos had for this neighborhood. OP zoning would indeed open up the possibility of apartments on this site.

Please deny any requests for a change in the present zoning for this property. This is neighborhood w limited access and parking. Commercial/professional property need to be limited in scope and intent.
