Dear Captain Block, My name is Kimberly Morgan and Officer Baily was the officer who responded to my call on 01/08/2012. I just got the police report for that day and Officer Baily’s report and Detective Mungroo’s report has fabrications about what happened and what I told them. See report #12-00655 Officer Baily, and Detective Mungroo’s statement. David Stephens is an old boyfriend. Our relationship was over 06/2011. He was incarcerated for 3 months for 6 felony charges in June.. (see attached). I dropped the charges and helped him get out of Fulton County jail. My reason: I felt bad for him in his situation even though he tried to Kill me and a innocent lady who stopped on the highway to help me and my son when David went ballistic on our journey to take him home at 4am in the morning, he also had stolen my pistol and used it to bust my sons head in 2 places, he attacked me from the back seat when we were in route to take him home and my son was on the passengers side .He man handled me took my keys to my Volvo and crashed it into the ladies car when I got into it and totaled out my Volvo. Before this situation when I was living in Gwinnett County David blew the motor up in pp Pick-Up truck, he took it without my permission, 1998 Dodge Ram and never paid me for it cost me 3,000.00 to repair. He also sliced my tires on my Volvo, in this situation he smothered me and I bit his arm to get it off of my nose and mouth, took my keys to my Dodge Ram Truck and I had to get the locks changed costing me 500.00. David asked me if he could use my address for his mail because he was homeless. I agreed. He also brought his clothes to my home without my permission. By me feeling threatened by him I try not to upset him because I know what he’s capable of. He told me he would give me money for the damages he caused to my vehicles’. I purchased a 1999 Silverado Truck and a Pontiac Grand Prix in December/2011 I called the police in December because he took all of my keys to the Silverado Truck and it is a steering wheel lock that he took the keys to. The Officer who came that night would not do a stolen vehicle report and stated he probably will be back if he’s not back by change of shift in the morning around 7am call us back. Well I think this was case # 11-18109 because College Park Records have this case # but it is a blank report. I keep asking for records for this report and there is none. David did not come back he also took the keys to my door I never gave him a key to my door; he took it when he took the Silverado Keys. I did not recall the police because I felt that the officer did not handle the situation appropriately and I would be wasting my time. This is what I told Officer Baily not what she wrote in her report. She wrote in her report that I said “I just didn’t want too”. On 01/08/2012 I called the College Park Police 3 times, Officer Baily has in her report that I called 2 times. This is what transpired on 01/08/2012: I had been asking David to leave my resident and he said he has no where to go. I was lying in my bed and he came and layed at the foot of my bed. I asked him politely to get out of my bed and I nudged his with my foot and said move. I asked him again to get up and nudged him with my foot again and said move. He didn’t move. I said move again and nudged him with my foot again. He didn’t move. The fourth time when I asked him to get off of my bed and out of my room he didn’t move and I nudged him again. Then he grabbed my foot with both of his hands and he twisted my foot in a 90 degree angle hurting my ankle and I twisted with my foot and I fell out of the bed. He then jumped up and I got up off the floor and he came at me and I started swinging to protect myself. I did not scratch him. I yelled I’m calling the police and he ran out the door taking my truck. In Officer Baily’s report she stated he had bruises. It was said in her arresting paper work that I scratched him. This is conflicting information on her part. I called the police and Officer Baily came. She said what’s the problem? I told her my X-boyfriend never returned my truck are house keys and he sprain my ankle. I want to report my truck stolen. She then got smart with me and said, Are you sure?! Did you give it to him to drive? At this point I became upset because I told her you could probably catch him with my truck and that she was letting him get away. I then told her that I wanted him to leave my apartment and she said since he was living here she won’t make him leave and I have to go and apply for an eviction notice. I asked her is it free and she said she didn’t think so and I told her I was on fixed income unemployment but when I do work I am a Professional Registered Nurse. She said do you have any family to loan you the money and I said no. Another Officer came in and at this time my phone rang and it was David. The male officer asked could he speak to him. I gave him the phone. He asked David did he twist my foot and he told David to bring my truck back David hung up on him but the officer stated that he did say he twisted my foot. The officers left. After the officers left I taped the lock and the handle of my front door with masking tape so he couldn’t get in. Then I went upstairs and was watching out the window. David pulled up was trying to come into my apartment and I yelled, I’m calling the police back and he jumped into my truck and pulled off. I went thru the back door to wait on the police. Officer Baily came and I yelled he just pulled off and she never got out her police car and she pulled off. I went back in the house through my back door and sat in the window. David pulled back up and came to my door and I yelled again I’m calling the police which I did. This time Officer Baily called my cell phone and said she had him and they would be pulling up. I sat in the window and David pulled up with Officer Baily behind her. I didn’t say anything I just sat in the window and Listened. Officer Baily and David got out of the vehicles and Officer Baily was talking very nice to David and she said to him, “Mr. Stephens, what’s going on here?” He responded to her that I got mad at him because he would not get out of my room and and at that point I yelled out the window, Officer Baily could you please get the keys to my vehicle and the steering wheel lock key and I need to go get the paper work to my truck and I will be down. At that point she said mean to me get down here right know are I’m taking you to jail. I had to find the papers to my truck and when I did I was nervous and shaky at this point and I went around the back because I had the door locks taped and when I got around to the front she yelled you are going to jail. You called 3 times. She also said raise up your shirt and pull up your pants leg so I can see if you have any marks on you. I said to her I am not going to expose myself to you out here in the parking lot and these men officers are around, she then snatched my papers out of my hand layed them on her hood and ruffed me up pretty bad because I have a torn rotary cuff in my left shoulder and she was hurting my arm and I have carpel tunnel in my left wrist and she put the hand cuffs on my wrists very tight. A man Officer came over and talked smart to me and I asked if I could go into my apartment and get my personal belongings my purse, cell phone and keys and he took me into the apartment and he saw why I didn’t come through the front door because I had the loc and the door handle bound with masking tape. When we came back to Officer Baily’s car she said get in you are going to jail and I was trying to talk to her and she threw me into the back seat she then put my papers to my truck in her trunk of her car. On the drive to the police station she threw me all around the handcuffs where cuffed on my wrists to the back hurting my shoulders and wrists. She did not put the seat belt on me to prevent me from being throwed around while she was driving FAST, HITTING THE BREAKS HARD, THROWING ME ALL AROUND. In her report she stated that I said I was claustrophobic so that’s why I wasn’t seatbealted in. When we got to the station Lt. Patterson came out and I told him how she threw me all around hurting me and I believe that’s why she put that in her report why I wasn’t seat belted in to cover herself. My point is this the initial call to the police department was because David had left with my truck, Officer Baily did not take the keys from David, I sat in jail for 16 days and he had access to my truck and my apartment and all my personal belonging. Why did Officer Baily allow him to keep the keys to my vehicle? I can’t do anything about it because the office allowed him to stay at my apartment and allowed him to keep possession of my truck. When we got to the station I told Lt. Patterson that she has the papers to my truck in her trunk and I wanted them in my property. He said he was going to make sure my truck papers got with my property. When I got out of jail 01/24/2012 I could not pick up my property because it was at Union Station. I was bonded over to Clayton County Jail. On 01/25th I went and got my property and my truck papers where not there. A few days went by I had to get myself together because I did not get to have a bond hearing so I had to sit in jail for 16 days before I saw Judge Mason. I went to College Park Jail, to Union City Jail, to Clayton County Jail and no one would let me be handcuffed in the front due to my torn rotary cuff left shoulder. I went to the infirmary in Clayton County Jail due to increased blood pressure and I caught the flu in jail so the reason I took my plea because the Public defendant said if I plead not guilty I will have to stay in jail until she got a bond hearing. My blood work was abnormal hemoglobin 7, normal 12-14 causing anemia, cold, chills. I just couldn’t do it. So now I have to take Domestic Violence classes, 40 hours of community service and 12 months supervised probation. I went back to College Park Police station and talked to Officer Williams and said I needed the paper work to my truck that Officer Baily had in her trunk and could I speak to Lt. Patterson. She called Officer Baily into the station and she said I gave them to your boyfriend. Why would she give the papers to my Silverado to David Stephens and he stole my truck and that was a part of the complaint of the initial call. David never told me he had my paperwork to my truck. Today I live in fear in my own apartment because College Park Police have done nothing to give me justice from being emotionally and physically abused by David Stephens. Right now today, he still has my keys to my apartment, the keys, to my Silverado, and the keys to the steering wheel lock. He has had an accident in my truck because I see a big dent in the finder that was not there and he said the reverse transmission went out. I will be moving out of my apartment this weekend because he won’t leave and I have been living in fear, hiding my money, and watching my important papers because he have destroyed and took these items in the past. He eats all my food up and don’t replace it, my rent is not paid for February, which I borrowed money to pay my rent for January and only stayed in my apartment for 2 weeks because I was in jail for 2 weeks and 2 days in the month of January. Detective Mungroo report is not true I was cooperating with her I am upset about this whole situation no justice has been given to me and David was allowed to keep my Silverado Truck and all the keys to my truck and apartment and he won’t give them to me. Lt. Patterson had an Officer go back to my apartment and told the officer to get my keys from David and it was a single key that was in my property and it was not to my truck. Kimberly Morgan, MSN, BSN, AND, RN Added this on 02/08/2012 Now I will address the discrepancies’ in Officer Baily’s police report that I picked up on 02/07/2012: I am submitting this letter because I went into the College Park Police Dept. on are around some the day I picked up the police report Case # 12-00655 to lodge a formal complaint on Officer Baily 1. Misconduct, 2. Excessive Force, 3. Not following proper protocol, by not explaining or giving Kimberly Morgan the option to take out a Warrant on David Stephens for stealing her vehicle, 4. Adding false statements to her police report that I Kimberly Morgan did not say, 5. Answering 3 calls to 911 to catch David Stephens in Kimberly Morgan’s vehicle and when caught him in it trying to escape did not obtain the keys to the Silverado truck, did not arrest him for a stolen vehicle after she put in her police report that the assisting Officer either Dorsey, H. (1326), or Johnson, H. (1974) stated that they talked to him on Kimberly Morgans cell phone and told him to bring the truck back if he did not and he was caught would go to jail. False statements in Officer Baily’s police report: 1.In Officer Baily’s report she started off, “I was dispatched to 1951 Southampton Dr. in reference to a domestic call”. When I called 911 I specifically said this call is in reference to “my truck has been stolen by my x-boyfriend!” This is an apartment complex maybe she was dispatched to 1951 Southampton Dr but my address is 1951 Southampton RD Apt. U-6. She did not come to Apt. U-6 for a domestic call the call to my Apt. U-6 on 01/08/2012 was for a stolen vehicle. 2. She kept referring to David Stephens as Kimberly Morgans boyfriend after I told her several times he was not my boyfriend our relationship ended 06/2011 when David Stephens spent 3 months in Fulton County Jail with 6 felony charges that I did not press charges on. I also when called 911 refered to David Stephens as my X-boyfriend. (Page 1 Police Report) 3. When asked why she didn’t call the police back when he returned she replied, “She just didn’t want too”. When using quotation marks that means exactly what a person said, “ SHE “I did not make this statement to officer Baily What I responded to the question was, “David never returned and if he did I would not have called because the officer did nothing when I called the first time he was trying to push his work off on another shift”(Page 1 Police Report) 4.In her report Mrs. Morgan stated she had scratches on her face from the altercation. I never told Officer Baily that I had scratches on my face. (Page 1 Police Report). 5. On page 1 of the police report when Officer Baily wrote Ms. Morgan stated to police she wanted to report her vehicle stolen. Ms. Morganwas informed a report would be taken and she could pick up a copyat the College Park Police Department in 3 business days. Officer Baily did not inform me that I needed to take out a Warrant on David Stephens or did she give me an option to take out a Warrant on David Stephens. This is where Officer Baily din not follow proper protocol in handling a stolen vehicle call which I made 3 times the night of 01/08/12 trying to recover my truck from David Stephens. 6. Page 2 of the police report states Officers were called to return to the apartment after male suspect returned. Upon arrival the male stated the incident took place because he did not want to have sex with Ms. Morgan. Mr. Stephens stated Ms. Morgan started to fight him while he was laying on the bed upstairs watching television. Ms. Morgan threw a bottle of perfume at him and jumped on him and started scratching hi up. First of all David kept coming to the apartment and I never opened the door, when I told him I was calling the police he jumped in my truck 2 times and fled. The Third time I called 911 Officer Baily caught him in motion somewhere near the apartment because she made him turn around and drive back to my apartment. David never returned and he was fleeing from the police after they told him if he didn’t bring my truck back and if he got caught in it he would go to jail. Officer Baily caught him driving the truck outside my apartment, and she did not recover my truck key, house key, are the steering wheel lock keys. Also I explained what happened (see above) if David told Officer Baily his version of what happened in her report this is a bald face lie. I have been trying to reach Lt. R. Pollard all day today, I came to the Police station 02/28/2012 and Officer Williams said he was in a meeting, I also asked for Lt. Patterson and she said he was in a meeting. I asked for the Chief of Police and she said he was in a meeting. Lt. Patterson on 02/07/2012 turned this complaint over to Lt. R. Pollard Internal Affairs Investigation. I briefly spoke with Lt. Pollard on 02.07/2012 and he said for me to get back with him and today, 02/28/2012 and prior calls with no return call. So now I would like for the Chief of Police Chief Fears to look into this situation. Kimberly Morgan 02/28/2012 To Whom It May Concern: I would like to lodge a formal complaint on the Clayton County Court System and the Clayton County Detention Center. I was arrested by the College Park Police Department on 01/08/2012 unjustly. I have a complaint filed with the College Park Police at this time and it has been with Lt. R. Pollard, Internal Affairs since 02/07/2012 and I have not heard from them or when I try to make contact he is always in a meeting. I was at around 5am on 01/09/10 transported to Union City Jail and was told this was College Park hold over because the College Park Police Dept. does not house prisoners. That morning I was suppose to see the Judge for a bond hearing, this was at Union City jail. They took me to Court that morning and the Solicitor called me up and said this is a state charge and we don’t handle state charges you will have to go see the judge in the morning at Clayton County Court. He did not let me speak to the judge so I did not have a bond hearing in Union City. When I went to intake at Clayton County Jail the lady who did my intake I told her that I did not see the judge for my bond hearing at Union City Jail and I asked her would I see the judge this morning for a bond hearing. She told me you already saw the judge and we don’t have in the system your next court date. I spoke to theSargent and he said he would look into it. I also spoke to the Lieutenant and he was very rude and disrespectful to me stating you already saw the judge at Union City Jail and you will not see the judge here. You have to wait for your court date. I did not see the judge for a bond hearing and I sat in jail for 16 days before I saw Judge Mason. My family was going back and forth from College Park Jail, Union City Jail, and Clayton County Jail trying to locate me for 4-5 days after I was arrested and no jail had information to give them about me, each jail told my family I was not in their custody and knew nothing about me! I arrived at Clayton County Jail around 12 midnight. This is day 2 that I did not have my High Blood Pressure medication. My head was pounding and I was dizzy. I went through intake and when I saw the nurse I told her all of this I have diagnoses of Hypertension, High Cholesterol, GERDS, and am on 5 different kinds of medication. Lisinipril 10mg, Norvasc 10mg, Spiralactone 25mg, Nexium, Simvastin 10mg. My Blood Pressure as up when she took it. I was very cold, and shaky. The nurse gave me Tylenol and wrote out a Special Needs Authorization Sheet for me to be on a bottom bunk. She also put me on the MD list to see a Medical MD, and the Psychiatrist due to my anxiety level was up and I have panic attacks. I can’t breath and I fear closed in places. I told this to the nurse. During my incarceration I never saw a psychiatrist. I had to take off my socks and bra because they were not white and that made me even colder. When I got into so called orientation it was around 3am on 01/10/2012. They gave me a bin. The mat had no padding in it and I did not have a wash cloth or towel for 3 days. I was on the bottom bunk. I was on lock down for 3 days. They called it orientation. I was not orientated to not one rule or regulation. I did not get a Clayton County Jail Handbook or I did not get to watch a video on what was expected of me. I got information on what to do from inmates. A inmate told me that Clayton County Jail receive $275.00 a day for each inmate they house. The conditions of the jail were not fit for a dog to live in. The jail did not use this money for the prisoners. The mats that they had were all cracked up and the padding was smashed down these mats needed to be replaced. I had a white sheet that had been sewn across 3 times with red thread and it was worn so bad that you could see threw it. The Uniform that I was given the pants was ripped on the side all the way up to the knee. Urine was leaking from the pipes from the ceiling and dripping down running under the door to my cell. This was when I was in so-called orientation. When I went to the Infirmary on 1/17/2012 the hot water did not work in my room and I could not clean myself. The cold water was cloudy mold was growing in the corner of the ceiling and the floor was trashy, dusty, and dirty and I had to put my plastic mat with no cushion on the floor to sleep. I was told by a CO do not push the button because if I do that is a way to make the CO mad at you. I pushed the button and no one answered it. I kept pushing it and the CO answered what is your medical emergency? I requested my blood pressure to be checked because my head was pounding and I was dizzy. They finally called me out to take my blood pressure and it was around 170/100. That’s high for me. When I got out of lock down for those 3 days I was transferred into Pod 3 and I went into a room that already had 2 ladies and the CO told me to put my mat on the floor. I requested another mat because the one I had had no padding in it and I went on the cement floor to sleep. My shoulders got stiff and very painful. To this day 02/28/2012 both my shoulders still hurt very bad and I went to the MD today and he put me on pain medicine Ultram 50mg every 6 hours as needed for pain. At this time I had caught the flu. My head was pounding my nose was clogged up with thick yellow mucus, and I was sneezing constantly. I went to the infirmary for 2 days and boy was I sorry. The doctor ordered blood work on 1-19-2012 and my hemoglobin came back 7. The normal range is 12-14. I was diagnosed as an anemic. Being anemic cause’s chills, coldness, listless, tired no energy. I kept asking for the doctor to write a special authorization for me to have a extra blanket or could get under the blanket and medical did not respond to my inmate requests forms. I had been incarcerated for at least 1 week before I started getting my inmate requests forms back! I was not given anything to keep me warm. I had funds put into my account and I ordered commissary. I ordered socks and Thermal underwear top and bottoms. When my commissary arrived I did not have my thermal underwear! This is what I needed to keep warm, I had no socks, no bra, I had on holey uniforms hemoglobin 7, chills, shaky, cold and I was in jail for 16 days like this! I have the list on everything that I ordered. Someone made sure that I did not get my thermal underwear. I have a list of inmates’ name, telephone number, and their complaints being incarcerated in the Clayton County Jail. (See attached) On 1/22/2012 CO Malloyd would not let me see the paramedics after I asked her and told her about my continuous headache, yellow thick drainage from my nose, sneezing, and hot. CO Shields would not answer the call bell when I pushed it when we were out on free time and when she did she told me , “You are not my concern, get these people for me in these rooms,” and she started calling out names and disregarded my concerns about my health. I requested to talk to Sergeant Mayo when I was running the fever, sneezing and she never came. CO Nelson and CO Adams was just plain mean to me. CO Allen stopped the line when we were getting our breakfast 01/20/12, and started swing her hand in my face while she was talking to the inmates and I moved back twice and she moved to keep her hand swinging in my face. CO Thompson was the only CO that followed through and did her job to the best of her ability. Thank you, CO Thompson. I requested reading material and never received any. I even did an inmate request form. 01/16-01/22 I kept writing inmate request forms about my illness nothing was done for me until after this date 01/22/2012. On 01/2/2012 I went to court and saw Judge Mason. The Public Defender I was appointed, Christy Wilson with the Law Firm Lister and Holt. 770-471-4433. The State of Georgia vs. Kimberly Morgan. I was charged 4 Counts. The PD told me if I pleaded not guilty I would have to stay in jail probably for another 10 days to get a bond hearing. I could not do that I was not guilty. She recommended me to plead a Nolle Prosequi which she explained not guilty or guilty. I agreed. When I got out I saw that I still had count 1 the other 3 where dismissed. I got time served for the $300.00 fine, 1 year probation, $49.00 a month, 25 classes on Domestic Violence Counseling at $25.00 a class, under the 1st Offenders. I thought this was dismissed also. This is not adjudicated and it is deferred upon completion of the 1 year and it will be not guilty. I thought this was not going on my record. I was hired with Amedisys Home care on 02/20/2012 and on 03/02/2012 the Director called me and terminated me due to the Battery charge that came on my background check! I was told by my PD that this would not be on my record and it is! I am asking to go back in front of the Judge change my plea to not guilty and be appointed a Public Defender. I cannot pay this probation, domestic violence and meet the terms of my probation without a job. I only have 3 more unemployment checks to draw. I am a Masters prepared Registered Nurse for 16 years and a Battery charge on my background check is unacceptable to employers because I deal with people, the young, adolescents, and the elderly and the sick. I had 30 days to appeal and I had been trying to get in touch with my PD and she has not been returning my calls and the solicitors office said that is whom I need to start with.
