This petition is to amend the definition of commercial vehicles in a manner that allows for the parking of said vehicles in the drive way of the home.

1. The presence of stenciling, lettering, logos, etc., shall not automatically define a vehicle as commercial purpose. So long as the vehicle does not meet the federal definition of a commercial vehicle (See 49 U.S.C. 31132, definition 1), vehicles with the aforementioned items in question will be exempt from this restriction.

2. Further, vehicles that are built on a passenger vehicle chassis and have been modified for commercial purpose, shall be exempt from this covenant provided they also do not meet the federal definition of a commercial motor vehicle. vehicles provided by a non-publically traded entity for their employees transportation to and from work as well as to be used during the course of their normal work day, shall be exempt provided the vehicle can be parked in the drive and is not parked in the street in a manner inconsistent with local traffic laws and does not impede pedestrian traffic.

3. It shall be the duty of the homeowner to submit a verification of qualification to the ARC for review. Upon receipt and acceptance of said verification, it shall be the duty of the ARC and the board to maintain a database of exempt homeowners and their commercial vehicles.

The current level of support provides the leverage needed to formally request a sit-down with the HOA board. I am now finalizing the draft of the policy amendment to present during that meeting.
