Petition to the New Jersey Department of Health to Permit

Swimming Lessons at Courtyard Luxury Senior Living

We, the undersigned parents and guardians of children enrolled in swimming lessons

provided by IVY SWIM SCHOOL, respectfully request that the New Jersey Department

of Health (NJDOH) consider approval of the waiver request to allow swimming lessons

at the indoor pool of Courtyard Luxury Senior Living, located at 111 W Main Street,

Clinton, NJ 08809. These lessons are a critical community resource, providing essential

water safety education, promoting physical health, and fostering intergenerational

connections in Clinton Township.

Background and Request: Courtyard Luxury Senior Living, a recently converted senior

living facility, has requested a waiver to maintain its specially exempt pool status while

allowing a certified third-party swimming instruction business to offer one-on-one

lessons for children in its 1,140-square-foot indoor pool (depth 3’-8”). We urge the

NJDOH to consider approving this decision, as the pool is the only suitable facility in

Clinton for year-round swimming instruction, and its use benefits both children and

senior residents.

Reasons for Supporting Swimming Lessons at Courtyard

Luxury Senior Living:

 Critical Water Safety Education: Swimming lessons reduce drowning risks, a

leading cause of death for children. The American Academy of Pediatrics

emphasizes early swim instruction to build water safety skills. With no other

community pool in Clinton, this program is essential for our children’s safety.

 Community Access: Clinton Township lacks alternative facilities for swim lessons.

The indoor pool at Courtyard Luxury Senior Living provides year-round access,

addressing a significant gap in community resources.

 Resident Well-Being: The presence of lessons enhances the quality of life for

Courtyard’s senior residents, promoting happiness and community engagement.

 Economic and Social Impact: The program supports local swim instructors who

rely on this pool for their livelihood, preventing disruption to their business and

ensuring affordable swim education for families.

Addressing Health and Safety Concerns:

We understand the NJDOH’s commitment to public safety under N.J.A.C. 8:26. To

address potential concerns that the NJDOH may have we commit to:

 Ensuring the pool meets all public recreational bathing standards, including water

quality testing and safety inspections

 Employing certified swimming instructors.

 Coordinating with Courtyard Luxury Senior Living to schedule lessons that

minimize disruption to resident’s pool access.

 Providing transparent documentation of compliance to the NJDOH and Clinton

Township Board of Health.

Hardship Without Approval:

The denial of this waiver eliminates the only indoor pool available for swim lessons in

Clinton, forcing instructors to cease operations and depriving children of critical water

safety education. This loss disproportionately affects families who rely on affordable,

local swim programs, particularly during winter months.

Call to Action:

We respectfully urge the NJDOH to consider approving the waiver request under

N.J.A.C. 8:26-1.4 to allow swimming lessons at Courtyard Luxury Senior Living. By

granting this permission, you will support child safety, community well-being, and local

businesses while maintaining strict health and safety standards.
