March 21, 2012 On July 27,2011, at approximately 3:10 p.m. at the intersection of 7th Street and Roosevelt, Ms. GJ struck My vehicle. The police arrived shortly after the accident occurred. They told Me the accident was 100% Ms. GJ's fault because Ms. GJ turned left on a red light and failed to obey the traffic light. The police report cites Ms. GJ for failure to yield right-of-way. On August 5, 2A11, RK, a Farmers lnsurance agent, told Me, my vehicle was a total loss. Inexplicably, I received a letter dated August 24,2011 from Farmers lnsurance's adjuster, BK, claiming that I was 50 % responsible for the accident because she was driving through/turning right on a red light. The police report disproves this allegation. As you know, the arbitration decision A005-06043-11-00 dated January 20, 2012 determined I am 0% liable for this accident. This decision is based on the police report, points of impact, and photographs of damage and extensive experience of the arbitrator. The statement notes M. GJ "driver failed to maintain proper lookout and failed to proceed in a safe and prudent manner even after recognizing danger." Therefore, GJ is 100% liable for the accident. Damages Given the substantial proof outlined above, I assert that Ms. GJ's negligence was the direct and proximate cause of My damages and personal injuries.
