The Law is currently biased against parents whose ex spouse/partner currently live in a different country.

1) You cannot have free Legal Aid for ANY stage of claiming child support if your ex lives in another country
(You can if they live in this country)

2) You can only claim back from the point of going to court, not from when the partner/ex actually leaves.
The difference in these two points can be years apart!
(You can claim from the point they leave if both parties live in this country)

3) REMO (Reciprocal Enforcement Maintenance Orders) are only reactive and not proactive on ANY given case.
(This is non negotiable as there are not enough people to work the cases, less than 10 members of staff to cover over 25,000 cases)

4) Unlike British courts where both parties go to one court. and the decisions are made there.
With Intrajuris-dictional orders. the procedure is as follows.

1)You go to Court (without ex)
2)Court takes papers to REMO,
3)REMO send papers to equivalent Government Agency in the country where your spouse/ex is located.
4)They send papers to Court
5) Ex goes to Court (without you),
6) Court makes recommendations
7) Papers go to Government Agency,
8) They send papers to REMO
9) REMO send papers to your Court
10) Your Court get in touch with you and
11) You then have to go back to Court to have the order confirmed or contested.

Once in court whilst there will be a legal advisor there.

They are not allowed to advise you.

They are only there to stop you (or the Magistrate)

accidentally/inadvertently breaking the Law.

Even if you're about to do something that will be of no

help to you, because you don't know differently, you

can't be advised not to do it!

5) It can take years to get everything resolved, sometimes the children can be grown by the time it's sorted.

Human Civil Rights says than an individual should NOT be treated differently and/or be biased against and therefore suffer hardship, for something that is outside their control.

Intrajuris-dictional child support is biased against parents in the UK who cannot afford legal aid.

International Law says that children should expect to live a similar or the same lifestyle they would have had if the two parents were still living together.
The extreme (years in some cases) delay in these cases being resolved mean that the children are unable to get the financial support they deserve and which is legally their right, at the time they need it, this can impact the quality of their lives, through no fault of their own.

This petition is to get the Law changed so we have the same rights as those who's ex partners/spouses live in this country. And also to get the money back that we've lost because of how this Law works against those who need it the most.
