Today in 2012 in Wales, the educational rights of our children are being violated, ignored or trampled all over~ and this is happening here, NOW in the 21st Centuary in Wales.

My son had his Statement of Educational written by the SEN Tribunal of Wales. They upheld his dyslexia, his Dyscalculia, his dysgraphia and his Dyspraxia.

Powys have now removed them all from him. They failed to maintain his Statement and provide his occupational therapy in line with his Statement. They have failed to do this since April 2011. At the beginning of February 2011, I started proceedings to have a Judicial Review of Powys County Council for failure to maintain a Statement of Educational Needs. They issued a Draft Statement giving me until the 23rd February 2012 to disagree with the changes to my son's Statement. On 17th February 2012 Ciaran's new final statement landed on my doorstep having taken EVERY specific learning difficulty off him, despite the fact that he has been diagnosed with ALL the above conditions. He now receives no entiltlement due to him as a diagnosed dyslexic and dyscalculate within the educational system. This re writing of his statement has also effectively stopped the judicial review proceeding and we now are looking at having to go back to tribunal where legal aid is limited.

It is because of this abuse of a loop hole within the Education Act that I want an amendment to be added to the Education Act, I want to campaign to add Ciarans' Clause to the Education Act and I want it to do the following:

We believe that it is only right and proper that:

 

When an Educational Authority has a Judicial Review Case opened for failing to maintain a child's Statement of Educational Needs as set out in that child's statement, then the Local Edcational Authority loses the right and the ability to amend, re write or re issue that child's Statement of Educational Needs until AFTER the Judicial Review case has been resolved."
