Child Protection and Offender Accountability Act

Subject: Introduction of the Child Protection Offender and Accountability Act
To: Honorable State Senators and Assembly Members
Dear Elected Officials,
We, the undersigned, respectfully urge you to introduce legislation that demands accountability for those who endanger the welfare of minors. Our proposed bill, the Child Protection and Offender Accountability Act, seeks to enhance the safety and well-being of children by addressing a critical issue in our legal system.
Section 1: Mandatory Bail for Offenders Accused of Endangering Minors
This bill mandates that any adult individual found to be endangering the welfare of a minor (ages 17 and under) through acts of sexual, physical, or emotional harm, or the distribution of explicit content, must have bail set. This includes any acts where there is intent to coerce, harm, or exploit a minor.
Petition Statement:
We, the undersigned, call upon elected officials and legal authorities to prioritize the safety of our children by mandating bail for those accused of endangering minors in such cases. The immediate safety of children must be ensured, and the accused must be held in custody during the investigation process or until a court reviews bail, ensuring the safety of the public and victims alike.
The bill covers individuals accused of:
- Physical or sexual misconduct toward minors.
- Communication intended to lure or abuse minors through any form of explicit content, including but not limited to instant messaging, texting, emails, social media and gaming platforms.
This legislation aims to ensure that perpetrators are held accountable and that victims are protected while the legal system conducts a thorough investigation. It reflects our collective belief that minors should not be left vulnerable, and that the legal system must act swiftly to prevent further harm.
Our justice system must evolve to prioritize the protection of minors over the freedom of those who engage in predatory behaviors. Allowing those accused of such serious offenses to be released on their own recognizance is unacceptable. We believe that child predators must be detained until appropriate legal proceedings occur.
We respectfully request that you consider this urgent and necessary reform. Our children deserve a legal system that acts swiftly and decisively to protect them from harm.
Thank you for your attention to this matter.
Sincerely,
Mr.Peter DiMiceli Protect Our Children N.Y.
