Cherokee County, TX Data Center Moratorium
PETITION TO THE COMMISSIONERS COURT OF CHEROKEE COUNTY, TEXASREQUEST FOR A TEMPORARY MORATORIUM ON DATA CENTER AND HIGH-DENSITY FACILITY CONSTRUCTIONTO THE HONORABLE COUNTY JUDGE AND COMMISSIONERS OF CHEROKEE COUNTY, TEXAS:
The undersigned residents and landowners of Cherokee County, Texas, respectfully present this Petition under the First Amendment of the United States Constitution and Article I, Section 27 of the Texas Constitution (Right of Remonstrance). We urge the Commissioners Court to immediately enact a temporary, one-year moratorium on the permitting, development, and construction of all high-density data centers, Artificial Intelligence (AI) compute facilities, and associated specialized power infrastructure within the unincorporated areas of Cherokee County.
- STATEMENT OF PURPOSE
This moratorium is requested not to permanently ban industry, but to provide critical "strategic breathing room". It will grant Cherokee County officials the necessary time to study, investigate, and draft enforceable regulations regarding the unprecedented operational demands of these facilities
- GROUNDS FOR MORATORIUM
Infrastructure Degradation: Heavy commercial construction and specialized high-voltage sub-stations place severe stress on county roads, bridges, and local right-of-ways.
Electrical Grid Instability: AI data centers consume disproportionate amounts of baseload power. Unregulated expansion threatens local grid reliability and poses risks to the safety and welfare of rural residential consumers.
Depletion of Water Resources: Many data centers rely on intensive water-cooling mechanisms. Unchecked groundwater or surface water consumption threatens East Texas aquifers and agricultural sustainability.
Public Health and Quality of Life: The continuous, low-frequency hum from industrial server cooling fans and dedicated power units causes severe noise pollution, other unknown health impacts, disrupting local communities and devaluing neighboring residential properties.
- PRAYER FOR ACTION WHEREFORE,
Petitioners respectfully request that the Cherokee County Commissioners Court:
Place an item on the upcoming Commissioners Court voting agenda to debate and enact a temporary, 18 month moratorium on new commercial data center developments in unincorporated county lands. Establish a temporary advisory committee to study the long-term economic, environmental, and infrastructure impacts of high-density computing on Cherokee County.
Formulate strict local guidelines concerning noise thresholds, water-use transparency, and infrastructure impact fees before any further development is considered.
