Dear Minister Kenney,

I'm writing today to ask you to waive the Requirement of Medical Admissibility (under s. 25 of the Immigration and Refugee Protection Act) under Humanitarian and Compassionate grounds for Charito Peralta and expedite her access to permanent status. 

Charito Peralta requires expensive medical treatment that she is only able to pay as a Live-in Caregiver. If removed to the Phillipines, she will not be able to afford the drugs she requires, and may die. Her family survived the Ketsana/Ondoy typhoon, and relies on her for economic support. Citizenship and Immigration Canada recognized the hardships her family is facing and expedited processing for her permanent application back in 2009. However, the second medical exam means that they are still waiting to be reunited.

Charito Peralta is a well-established member of her community. She has worked in Toronto for the last four years, is an active member of her church, Jesus is Lord. She participates actively in “Caregivers’ Weekend Socials”, a program of People and Organizations in North Toronto and is a member of Caregivers Action Centre. I am writing today to add my voice to the 600 members of her Church who have written a petition to you to ask that she and her family be granted permanent status.

Charito Peralta left her home when her son, Adrian, was at a very young age. It is important that he be re-united with his mother at this critical juncture in her life. As such, I'm also asking that you grant permanent residence status to Charito's husband and son.

Had Charito applied for permanent residence status after April 1, 2010 when the so-called Juana Tejada law came in to effect, she would not have been required to undergo a second medical examination and would not have been considered medically inadmissible as her medical condition is not a threat to public health or safety. It is fundamentally unjust that Charito Peralta be denied permanent residence status simply because she had the bad luck of submitting her application before the regulatory changes took effect.
