Please help save our little family from the German State that is interfering in our private life, and wants to annul our marriage on the 15th of October 2014. This is being done only because my wife Jana Katharina Chugh, happens to be a German Citizen who chose to marry a foreigner, a Canadian of Indian origin. My wife is three months pregnant, and we have a four year old son Carlos.

We got married in April 2011 at Santa Monica, Los Angeles County, according to the laws of the State of California and USA, which are recognized by Germany. What right does Germany have to annul a marriage which wasn't even performed in Germany? My first marriage and divorce was done in India. Then how can German officials accuse me of bigamy, when they are writing themselves that I am legally divorced since 1st of December 1998 according to Indian law?

In 2010, German officials from the German Embassy at New Delhi (India) had already checked my identity, my passport, my birth certificate, my school certificate, the marriage certificate of my first marriage, and the divorce decree of my first marriage. These documents were not only checked in the relevant offices in India, the German Embassy in New Delhi had also sent their so called lawyers of confidence (basically criminals, as they turned out to be detectives from an agency hired by the German State) to investigate my whole family. It is illegal, and a crime to investigate anyone like this without permission from a court of law in India. German officials not only broke Indian and German laws, by criminally trespassing into my family’s residence in New Delhi, Germany broke the laws of all democratic nations. My two sisters, and my father who was a heart patient on medication, were questioned for about one hour. These so called lawyers of confidence didn't even hesitate to ask my father about his divorce and separation from his wife, which had nothing to do with my marriage. Several personal pictures of me and my wife and other photographs and documents were taken away by these criminals without my consent. Many German Officials claim that this is a normal process to treat peoples of certain countries, and how it could be worse for some, but other German Officials were horrified and completely denied that Germany could commit such illegal acts. They claimed that everything is done so secretively by German Officials in foreign lands, and how they have a lot of power and are unanswerable to anyone in Germany.

Now German officials like Dr. Katja Schurr are sending us letters, threatening us that they will annul our marriage, if we don't pay them another fee of about 300 Euros, so that they can continue with their completely illegal, unethical, immoral and inhuman ways of verifying my divorce a second time through their illegal and criminal agents posing as lawyers. Lawyers cannot legally go to anyone’s house to investigate. Even Chancellor Merkel cannot legally go to anybody’s house to investigate anyone.

Our first choice was to get married in Germany so that my wife’s family, relatives and friends could attend the ceremony. During that time, my wife was expecting our first child. As my wife’s parents were working and could not travel to India, we decided to have the birth of our child in Germany, because of the emotional support my wife would get from her parents. But soon we found out that the German State keeps a discriminatory list of countries, all non-white, for whose peoples and citizens it is almost impossible to marry a German or have a child with. The fact that such a list exists, in itself is discriminatory. The fact that this list consists of countries, which are all non-white only, is racist. According to Germany, even though I am a Canadian Citizen, my fault is that I happened to be born in India.

In Germany, there are horrible unthinkable rules from the time of Nazism, that originate in the earlier Nuremberg laws regarding ‘German Blood and German Honor’, concerning pure Germans marrying others, especially against marriage to Jews and certain foreigners, where a marriage would be annulled even if a German citizen married such a person in a foreign land. This is being implemented now as is highlighted by our case. None of us were aware that in Germany, if a white person falls in love with a non-white person or vice-versa, the consequences can be so huge. German Authorities keep finding something or the other to keep harassing us with extra documentation that is a complete waste of time, expensive, and infringes on our basic human rights and violates the rights of our child, making our lives as difficult and miserable as possible. This endless mental torture, humiliation and injustice has been going on for over 4 years now, for us and for our parents as well.

I was legally divorced on a mutual consent basis in a court of law on 1st of December 1998 in connection with my first marriage. That is over 15 years ago, and these documents were submitted to German Authorities on the 8th of June 2010. These court documents regarding my divorce, all in English, were officially checked in India, and verified to be true by the German Embassy at New Delhi, which investigated the matter illegally, beyond what was required, breaking laws of all democratic civilized nations including German constitutional laws concerning privacy, equality and marriage. Germany is a signatory to the Hague Convention but refuses to recognize documents from India. During the process of checking my documents, the German State and its’ Officials committed criminal trespass into our house, and criminal acts which are unthinkable by all decent human beings, about which we had already sent letters of complaint to Chancellor Angela Merkel’s Office, to the German Foreign Minister at that time Mr. Guido Westerwelle, to the German Ambassador to India at that time Mr. Thomas Matussek, and to other concerned officials including the Mayors of Salem and Überlingen. German Officials have immunity from legal action, which is why we could not take any legal action to file a criminal lawsuit against them.

These highly insensitive German Officials created infinite problems during our first child’s birth. They created lots of obstacles and hurdles for us to get married. The German State has created an insensitive inhuman process that dehumanizes and degrades other humans from certain races, and certain nations to treat them as unequal and as lesser human beings. We felt we are being discriminated against, contrary to the principles of natural justice and fairness, just because one of us is a non-white foreigner. As far as we are concerned, it is entirely the fault of the German State, its’ officials and employees, as they with common intention made sure that it was impossible for us to marry in Germany, even though we spent a lot of time and money, and tried very hard to abide by all rules, to have a normal marriage with basic human dignity within Germany.

We refused to accept this form of State Sponsored Institutional Racism and instead chose to marry outside Germany, at Santa Monica, California, U.S.A. It took the inefficient German State four months to check my documents, as we got them back on the 7th of October 2010, officially stamped and accompanied by a letter stating them to be true. We got married six months after that on the 7th of April 2011. Now, even though we are not living in Germany, and even though we did not get married in Germany, the German State still refuses to leave us alone, and has made our life hell. It has happened two times, that exactly on our son’s birthday, Dr. Katja Schurr representing the German State has sent us a notice to annul our marriage. Germany has threatened to start this process of annulling our marriage on the 15th of October which is coming up in about two weeks.

German Officials are now demanding that I provide them with personal and private information regarding my first marriage, documents and passport details and photocopies from my ex-wife’s passport etc. I do not agree with this extreme intrusion of privacy or this form of discrimination and racism. How is it possible that I provide them with all this when I am not in touch with my ex-wife since the last 10 years or more? And Germany wants a written approval from my ex-wife that my present marriage is ok with her. Germany has some very sick Officials who make these rules, and it seems German Officials want me to go through a horrible process similar to a second divorce from the same person. Germany wants me to pay for this privilege of having my rights abused. This is the second time that the German State is demanding a discriminatory fee from us, as no German who marries another German, or a foreigner, who happens to be born in a so called white country, has to go through this horrible process and have their rights abused in a similar manner. Germany specializes in this, as earlier too Jews had to pay Germany the costs for the privilege of being transported to concentration camps.

When German officials and bureaucrats abuse the rights of a German citizen to marry a person of her choice, create hurdles and barriers, keep delaying documentation for our marriage and birth of our newborn child, make us run in circles and delay our wedding in Germany that our parents, other family members, friends and relatives wanted; when we were pushed to find other legal options to get married in a country whose laws are non-discriminatory or racist, a country whose laws the German State recognizes; then what is the problem with our marriage at Santa Monica, California in U.S.A.? Is that a crime?

The authorities in the State of California clearly recognized that I am legally divorced. All other countries recognize my earlier divorce except Germany, even though it is the German State that has verified and checked my divorce documents which were returned with an official seal, signature and a letter from the relevant authorities.

German officials and bureaucrats have a long history of committing crimes against humanity including their own citizens. And Germany has always had strange laws which have been voluntarily implemented by over enthusiastic insensitive bureaucrats and officials that have harmed other humans. No other democratic nation has embedded Institutional and Structural racism at the highest level and at the lowest levels like Germany. Germany has disguised Nazism in a complex web of rules and laws wearing misleading masks that eventually implement the same idealism and beliefs leading to the same end results. One has to wonder if German Officials are upholding Germany’s present day democratic traditions, as they definitely are not working in the best interests of two German citizens, and neither are German Officials defending the German Constitution by committing these highly illegal acts. They should be declared enemies of the State, as all they are doing is continuing the earlier traditions of Nazism, even though Nazism is officially over.

German officials are threatening us ultimately with imprisonment, if I do not pay them and sign up, to start a new process of abusing my basic fundamental human rights. This is not how humans celebrate marriage, or enjoy the birth of their child. German Officials have not only taken away our rights to enjoy our marriage, and the birth of our child, but the rights of our parents as well, to enjoy the daughter's wedding, and the birth of their first grandchild. We believe this interferes with our basic civil right of free choice as it is our fundamental right to choose who we love and marry and have a child with, and the State has no right to interfere in our free choice!

Till now the actions of the German State have been inhuman and uncivilized no matter how one justifies them. When something is unequal, unjust, unfair, unreasonable, and wrong, both morally and ethically, then usually it is illegal, even according to the present laws and Constitution of Germany, according to the 'European Convention on Human Rights', and according to the 'Universal Declaration of Human Rights'. And it is illegal according to the Canadian and Indian Constitution, and the rules and laws of every civilized nation. German Officials are violating Articles 1, 2, 3, 4, 6, 13 and 19 of the 'German Constitution', Articles 1, 3, 5, 8, 9, 12, 13, 14, and 17 of the 'European Convention on Human Rights', and Articles 1, 2, 3, 5, 6, 7, 12, 16, 18, 22, 25, 28 and Article 30 of the 'Universal Declaration of Human Rights'.

Germany, please stop trying to destroy relationships, and stop breaking up families, and stop trying to alienate affections between humans by disrupting relationships and marriages in the name of your unreasonable rules being implemented by a legalized system of discrimination and racism. Where is the human dignity in such actions? And where is the dignity of German Officials to sanction such acts? We do not agree with it, and do not accept it. It is unfair.

One victim and survivor of Germany's crimes in the past said, 'there may be times when we are powerless to prevent injustice, but there must never be a time when we fail to protest. The world is a dangerous place to live in, not because of the people who are evil, but because of the people who don't do anything about it'

We should recollect the principles declared at the Nuremberg trials in 1945. Individuals and Officials have international duties that transcend national obligations of obedience. Citizens have the duty to violate domestic laws to prevent crimes against peace and humanity from occurring. If we remain silent, we are condoning this illegal behavior, encouraging future criminal acts by the German State and its’ Officials. All I can wish for is that one day there will be another set of Nuremberg trials where German Officials have to account for crimes still being done by the German State against fellow humans. I hope Germany will then get a chance to reflect on its’ actions, to confront itself, and be forced to answer its’ conscience. If it has one!
