The Act fails to acknowledge the well-established legal distinction between games of skill and games of chance, treating both as equally prohibited if played for monetary stakes. Users who previously engaged in games recognized as skill-based—such as rummy, poker, or fantasy sports—will now face the same restrictions as those who participated in gambling or chance-based games. This means legitimate forms of entertainment and even professional skill-based gaming are now banned if there is any monetary involvement, removing a source of recreation and potential livelihood for many. While the Bill aims to protect young and vulnerable populations from the risks of online gambling addiction or fraud, it also eliminates access to competitive e-sports, fantasy sports, and career opportunities in India’s rapidly growing digital gaming sector for everyone interested in legitimate, skill-based games.
