35551 Palomares Rd Castro Valley, CA 94552 This ordinance is critically flawed in the ways described in this petition and I do NOT support the rushed passing of this incomplete ordinance. It would have disastrous consequences to home owners with well maintained septic systems with no signs of problems. It would be an economic burden beyond what many are capable of bearing for home owners that have well maintained and well functioning septic systems. Furthermore, the requirement of original construction permits for existing systems in order to comply, when the county itself lost the original permits, makes the homeowner responsible for failures of the county itself. Such rules are at best unfair to the home owners and are under no circumstances acceptable.

Trying to rush this through the Board of Supervisors because ACDEH failed to meet a timeline is irresponsible. This lacks real and reasonable community input to what the program is. The proposal is veiled as a local agency management plan for onsite water treatment and most people don't realize these are mandatory inspections of all septic systems at a high cost to the property owner. When there is no evidence of a dangerous condition and proposed warrantless inspections of all parcels in the unincorporated areas from Oakland to Livermore, Sunol, and the Castro Valley Canyon Lands, lacking documented reasonable cause of a dangerous condition is an illegal inspection. Threatening owners with condemnation of their property and the original intent to seek misdemeanor criminal charges is beyond the County's authority and violates the property rights of the owners. The proposal is far and above the State standards. ACDEH intends to ask the Board on May 10th to approve a limited portion of the proposal now with a completed proposal to follow. This is not representative of the Boards constituents. ANY form of this proposal is premature and a liability for the County. Nothing should go forward and any proposal needs to be a complete proposed ordinance, then carefully and completely, not partially, reviewed by County Counsel. Any review or approval of a partial proposal is irresponsible and reckless. It fails the constituents of the Alameda County Board of Supervisors.
