CASTLE ROCK RESIDENTS PETITION

CONCERNING PHILIPS SQUARE REZONING REQUEST 16-0066

To Whom It May Concern:

Residents of Castle Rock strongly oppose the current rezoning

and concept plan of Phillips Square. We are not opposed to the

mere presence of a multifamily development near our

neighborhood, but rather certain aspects of the design including

the use of Castle Rock Parkway as an entrance and exit to this

development, and the proposed development of land within the

100-Yr. Floodplain.

While residents understand the current rezoning request may

reduce traffic generated by the development from projected

levels of the 2010 approved design, we also feel that the

approval of the 2010 design was made without adequate or

clear representation of facts, and lack of due process for Castle

Rock Homeowners.

Residents of Castle Rock understand the rezoning request

applied for in 2010 was recommended for approval by P&Z, but

with suggested restrictions aimed at addressing concerns of

residents which included traffic safety, potential hazards of

developing land within the 100 yr floodplain, and loss of

neighborhood integrity. Since that time, the 2010 City Council

and the present P&Z staff have failed to show any real interest

in resolving or clearly addressing resident concerns.

Currently, resident concerns with traffic safety include but are not

limited to:

1. Seemingly illogical and inaccurate assumptions of traffic flow

patterns contained in the 2010 TIA. Since that time, the only update

to the TIA included traffic counts in and out of Castle Rock

subdivision. To date, the unreasonable assumptions regarding

traffic flow patterns remain.

2. Reduced pedestrian safety due to increased traffic on Castle Rock

Parkway.

This includes concerns for current and future residents of both

developments using the walking paths for exercise and access to

Castle Rock Park and the neighborhood pool, as well as children of

various ages who are picked up and dropped off by school buses

along Castle Rock Parkway.

Concerns regarding the development within the 100-Year Floodplain and

in close proximity to green spaces include:

1. Possible alteration of FEMA 100-YR flood plain boundary,

causing homes located in Castle Rock and Reatta Meadows

Subdivisions to be included. A condition detrimental to

property values of those residences.

2. The wetlands, green belt, and environment will be disturbed

and ultimately impacted by construction and there is no way

to determine the loss until this and other surrounding

developments are complete.

Residents of Castle Rock respectfully request that City Council deny the

applicant's current rezoning request and proposed concept plan in lieu of

one that addresses resident concerns and provides benefits for all

affected parties.
