Let Bryson residents conserve water with xeriscaping
Currently the Bryson ARC is frequently denying requests for Xeriscaping. Per the Bryson HOA manager "The ARC for Bryson has a history of declining xeriscaping applications".
Due to the central Texas drought status, lack of rain, high summer temperatures, the need to conserve water, and rapidly increasing population/demand for water, we are asking Bryson ARC/HOA to reconsider their current aversion for letting residents to fully Xeriscape their yards. The last thing we need to wasting our water on is grass. If a home owners chooses to xeriscape to conserve water, they should be allowed to.
Definition of Xeriscaping: Landscaping in a style that requires little or no irrigation.
Brysons current Xeriscaping Policy: (key points in quotes)
"Approval by the ACC under the Declaration and/or the Architectural Guidelines for Bryson is required prior to Xeriscaping. Some Sections within Bryson may have Xeriscaping requirements specific to those particular Sections which are contrary to or in addition to the terms and conditions contained herein. Each Owner must review and comply with any and all Restrictions applicable to Owner's property".
Just this statement gives Bryson the ability to decline and or approve any application they choose to. This is not allowing residents to Xeriscape. They are still making sure they have full control to decline xeriscaping applications for whatever reason they see fit. Our xeriscaping was denied and we were told to replant grass to our front yard, we were not given an explanation on why we were denied.
"No Owners shall install gravel, rocks or cacti that in the aggregate encompass more than 50% of such Owner's front yard or more than 50% of Owner's backyard."
Currently Leander is at stage 2 water conservation. This allows for once a week watering with irrigation systems. This is not enough to keep even 50% grass alive. We should be allowed to fully xeriscape our yards if we choose to. We should be able to conserve water for our community. Let's encourage the Bryson community to be a leader in the conservation of water. Again, our yard was denied for xeriscaping, we were not told that we could have 50% grass, we were told to remove all gravel and replace with grass. Per our HOA manager: "The ARC committee and the Board of Directors met on Friday to discuss your xeriscaping and have agreed that the areas with the black rock must be replaced with grass."
Texas laws:
HOA's can enforce guidelines or require prior approval for xeriscaping, but the can't "unreasonably restrict" our ability to conserve water with landscaping.
The ARC/HOA is unreasonably restricting our ability to conserve water by denying our xeriscaping and requiring us to replant grass. They have done this to other residents as well.
The featured photo is our front yards Xeriscaping that was denied by the ARC/board of directors of Bryson. They are asking that all the dark rock be replaced with grass. As you can see, this is all of our yard. Only our garden beds and not required to have grass. Please sign this petition if you disagree with Bryson's current regulations/rules that limit residents ability to fully xeriscape and conserve water. I have a meeting with the Bryson ARC and board on July 27th to discuss our yard and the reason for denial. I would like to show them that the Bryson residents support full xeriscaping. Brysons residents opinion matters!
