Internal Revenue Service: This is a petition sent by Andrew J. and Kimberley C. Brocchini in response to letter from IRS which states that more tax is due for tax year 2008 because information on the filed return did not match up with what was reported to the IRS. We agree that there were some mistakes made on the 2008 return and we will go thru each line item, as the results we got were different from those the IRS has indicated on the letter. I have also included a copy of the form which illustrates each line item and the changes that we calculated. The 1st item is the interest reported on our return was $1142. which was a mistake on our part. We put the Redwood Mortgage K-1(1065 Form) with the interest and actually had estimated the amount at $1100 because I had not yet received the K-1 when I filed. The actual amount for interest would be $86 total($50 from BofA Savings and $36 from Golden one Credit Union Savings) So the $1192 listed by the IRS for the 1st line item is wrong. The taxable income is therefore $130,264 and not $131,167 as shown by the IRS so the difference is actually $604 less than that shown by IRS. The tax then per line 44 should be $25,254 and not $25,479 which is a difference of $151 more tax. We agree with all the other line items and come up with a net tax increase of $4948 which because the amount is less than $5000, there is not a 20% accuracy penalty for substantial tax understatement. At this time because we do not have the funds to pay in full we would like to set up a monthly payment plan to pay this tax bill in 4 years.
