to impunge the cgit order in which it is directed to reinstate the terminated employee with full back wages . the employee was terminated from service in 1997 on account of unauthorised absence from duty on several occassionb . it was observed by by CGIT that he was worked for more than 240 day hence his services shall not be terminated owithout conduction proper enqiury as per art 25 ID ACT . the court has not taken into cognigance about his unahtorised leave pewriod while calcualting 240 day . as per official record he served the office only 152 day . hence art 25 as well as 10 is not applicable . while giving the benefit iof full back wages court has not gone into detail that whether the person was gainfully employed or not while reinstating the service of individual court has not consider the fact that he has not shown devotion towards his duty in the while he has been offered appointment twice
