I had the same situation, my children's father passed away a month before I had my daughter however my solicitor won the case with letters from his parents to prove he accepted parentage and also birth certificates from our other two children, no DNA test was required I'd seek advice as you shouldn't be made to go down the route of DNA. It took a few court visits but I won his name is now on my daughters birth certificate. Good luck .

no child should be denied the right to have their fathers name on their birth certificate as though its not bad enough he will sadly not be in her life at least she will have that connection with him.
