Amend U.S. Constitution to forbid Federal taxes on a FAILURE to purchase goods or services
Whereas, the Supreme Court of the United States has decided in National Federation of Independent Businesses v. Sibelius (2012) that Congress can impose a tax on a FAILURE to purchase goods or services, in this case on persons who do not purchase health insurance; and
Whereas, this will most certainly lead to the Congress indirectly requiring commerce, in violation of the Constitution, under the auspices of its taxing power.
This must be ended. Therefore, I propose that an amendment should be added to the U.S. Constitution to ban this potential for abuse. The amendment should read as follows:
"Congress shall make no law that imposes a tax on a failure to purchase goods or services."
This would render Obamacare's individual health care mandate unconstitutional. It would also preclude Congress' ability to illegally indirectly require commerce via its taxing power.
