To amend the California Unfair Business Practices Act in order to correct the practice of torturing statutes and contractual language in order to reach a desired ruling, I am proposing a change to the California Business and Professions Code, 17200-17210. Currently, the California Business and Professions Code, in Sections 17200-17210, states that “unfair competition shall mean and include any unlawful, unfair or fraudulent business act or practice and unfair, deceptive, untrue or misleading advertising.” The goal of this petition is to amend the law to read more accurately: “unfair competition shall mean and include any unlawful or fraudulent business act or practice and deceptive, untrue or misleading advertising.” Consumer rights, penalties and prosecution vis-à-vis section 17200-17210 shall remain the same. This change is necessary to correct both, the use of the word "unfair" to define itself; and also to close a loophole that allows inaccurate judicial inclusion or exclusion; as opinions from the bench were never intended nor should ever be used as evidence in a case. Opinions can be made binding law when a fact is discovered, but opinions cannot be made in lieu of fact. Quality --while not a goal in and of itself, should be an active pursuit of all law students and practicing lawyers. This petition will be the first step on that path. I hope that all law students --in California primarily, and elsewhere will join me in this very worthy pursuit. This petition will be forwarded to the Governor and the California State Supreme Court.
