There is a large common space in front of the building B of the Aquila Garden residence (further ‘residence’).

This space has been used in the last five years mainly to:

1. allow access for removal cars due to its strengthened, solid ground

2. provide a safe, demarcated area for several children living in the residence to play during the afternoon after having come back from school

Up to now a compromise has always been reached with neighbors living in the residence, especially with those living on the ground floor of the building B, to let kids benefit from this common area.

Kids playing outside is a part of normal living in any residence and thanks to them, adults also gather outside which contributes positively to our living together in the residence and to stronger and harmonious neighbors' relations.

In September 2022, new signs have appeared in several places in the residence prohibiting kids to play in the residence with any ball.

This measure has been introduced without a prior communication coming neither from the syndic nor from the assembly of owners to clearly explain and justify to us, the residents, the need for such a zero-tolerance measure.

Up to now, no harm and no material damage has been caused to anybody living in the residence because of the kids playing outside with a ball. We have always managed to reach a compromise solution to any situation so that we could live in harmonious neighbors' relations.

With this petition, me, undersigned, living in one of the apartments in the residence, is requesting the assembly of owners of the Aquila Garden residence to agree on a compromise solution regarding the use of the common areas in the residence.

Such a compromise would:

1. allow kids living in the residence to play with a ball in a safe common area after coming back from school during clearly specified hours (e.g., 15-18 o’clock)

2. ensure the respect of residents’ rights not to be disturbed in late daily hours

3. keep informed the residents (including the tenants) of the Aquila garden of any decisions made by the assembly of owners which impact the way of living in the residence
