Non compete agreements are best utilized by companies that have trade secrets to protect but in the relationship of trucking companies with drivers, there are no trade secrets to protect as drivers do not have any business relationships with any of the trucking companies customers whether they are shippers or receivers. The trucking companies have been using this as a means of retaining drivers who have taken training classes/refresher courses even if the driver may have had plans to work elsewhere. Non compete clauses were not meant to prohibit someone from making a living at the company of an employees choice, they were meant for companies to protect trade secrets such as recipes, proprietary software, inventions, products, etc. Therefore we the undersigned professional drivers are requesting that the Federal Motor Carrier Safety Administration and any other relevant government agency which governs/regulates the trucking industry, outlaws non compete clauses as they pertain to the relationship between a trucking company and a driver/employee.
