ON APRIL 5TH, 2017, THE CITY COUNCIL OF THE OF LAS VEGAS HAS THE APPROVAL OF BILL 2017-3 ON ITS AGENDA.

BILL 2017-3 REVISES THE ORDINACES THAT GOVERN THE COLLECTION AND MANAGEMENT OF SOLID WASTE AND RECYCLABLE MATERIALS IN THE CITY OF LAS VEGAS.

NOT ONLY DOES BILL 2017-3 THREATEN TO IMPOSE A DIRECT AND SIGNIFICANT ECONOMIC BURDEN TO THE CITY'S RESIDENTS AND BUSINESSES (SEE DETAILS BELOW,) THE APPROVAL OF BILL 2017-3 IS DIRECTLY TIED TO THE APPROVAL OF THE REQUESTED FIFTEEN (15) YEAR EXTENSION OF THE FRANCHISE AGREEMENTS HELD WITH REPUBLIC SERVICES FOR THE COLLECTION AND DISPOSAL OF SOLID WASTE, AS WELL AS THE OPERATION OF THE LANDFILL. THE CITY IS CURRENTLY IN NEGOTIATIONS FOR THESE EXTENSIONS- EVEN THOUGH THE CURRENT AGREEMENTS DON'T EXPIRE UNTIL 2021!

ALSO ASK YOURSELF…ISN'T IT A CONFLICT OF INTEREST FOR ANYONE THAT RECYCLES, THAT THE ONLY TRASH HAULING COMPANY YOU ARE ALLOWED TO USE ALSO OWNS AND OPERATES THE ONLY LANDFILL? AND IF IT IS WAS CHEAPER TO THROW IT AWAY AND DUMP IT IN THE LANDFILL THEN IT IS TO PICK IT UP AND SORT IT, WHAT INCENTIVE WOULD THEY HAVE TO PUSH RECYCING??

PLEASE SIGN THIS PETITION AND LET THE ELECTED OFFICIALS KNOW THAT YOU DO NOT AGREE WITH THE ADOPTION OF THIS BILL OR THE EXTENSION OF THE FRANCHISE AGREEMENT.

LET'S OPEN THE TRASH AND RECYCLING COLLECTION MARKET UP TO ENCOURAGE BETTER SERVICE AND BETTER PRICING!! THIS PROCESS WORKS EVERYWHERE ELSE, THERE IS NO REASON THAT IT CAN'T WORK HERE!

AND THE RESIDENTS AND BUSINESS OWNERS OF LAS VEGAS SHOULD BE TREATED FAIRLY AND PROVIDED WITH ACCURATE INFORMATION BY THEIR GOVERNMENT AND ELECTED OFFICIALS.

DETAILS BELOW:

HOW BILL 2017-3 NEGATIVELY IMPACTS BUSINESS OWNERS AND RESIDENTS:

LEAVES YOU WITHOUT THE RIGHT TO CHOOSE YOUR HAULER AND WITHOUT ANY NEGOTIATING RIGHTS

INSTITUTES LARGE NEW FEES FOR FRANCHISED SERVICES (I.E. TRASH COLLECTION AND CURBSIDE RECYCLING)

ALLOWS THE FRANCHISEE TO IMPOSE NEW FEES ON FRANCHISED SERVICES ‘AT ITS SOLE DISCRETION.’

REMOVES THE CUSTOMER SERVICE STANDARDS SECTION IN ITS ENTIRETY FROM THE VERY DOCUMENT THAT GOVERNS THE FRANCHISEE AND PROTECTS US!

APPROVES THE SINGLE STEAM RECYCLING PROGRAM IN THE CITY OF LAS VEGAS:

EVEN THOUGH THE CURRENT RECYCLING RATES DO NOT SUPPORT THE CHANGE

REPUBLIC PREDICTED SINGLE STREAM WOULD ‘YIELD INCREASE OF 500%

RECYCLING RATES HAVE DECREASED EVERY YEAR

ACTUAL NUMBERS REPORTED TO THE SOUTHERN NEVADA HEALTH DEPARMENT SHOW AN OVERAL DECREASE IN RECYCLING RATE EVERY YEAR SINCE 2012, INCLUDING AREAS THAT HAVE INSTITUTED SINGLE STREAM RECYCLING.

IN 2013 - THE SNHD STATES THAT ITS RECYCLING RATES REFLECTED DOUBLE COUNTING IN THE INFORMATION PROVIDED BY THE FRANCHISEE IN PREVIOUS YEARS.

THE PROPOSED SINGLE STREAM RECYCLING PROGRAM SIGNIFICANTLY REDUCES COLLECTION SERVICE TO RESIDENTS, WHILE:

PRICE RATE WILL CONTINUE TO RISE, EVEN THOUGH SINGLE STREAM EQUALS:

LOSS OF JOBS/TRUCKS ON ROAD + LOSS OF SERVICE = MASSIVE INCREASE OF REVENUE FOR REPUBLIC!

FUNDING FOR CURBSIDE RECYCLING ACTUALLY BEGAN WITH A RATE INCREASE OF $1.25 PER HOUSE AND 18% INCREASE TO BUSINESSES IN 1991. BUT PER AN AUDIT PERFORMED BY CLARK COUNTY YEARS LATER... ' so, although the increase was granted … that a recycling program was implemented… the increase was blended into the rate structure and considered part of the overall revenue in future agreements…’ THIS AMOUNT NOW EXCEEDS THREE (3) MILLION DOLLARS PER MONTH IN ADDITIONAL REVENUE TO THE FRANCHISEE!

INSTITUTES PRACTICES THAT WILL CAUSE SIGNIFICANT HEALTH AND SAFTEY ISSUES TO CITY BUSINESSES (9.08.320. (B) AND (C)

SECTION 9.08.320 (B) AND (C) WILL NOW ALLOW THE FRANCHISEE TO WITHHOLD FRANCHISED TRASH SERVICES AS A METHOD OF BILL COLLECTION AFTER 60 DAYS. THIS SECTION DOES NOT CONTAIN ANY LANGUAGE TO PROTECT THE CUSTOMER AGAINST DISPUTED OR UNAPPROVED BALANCES, NOR DOES IT CONTAIN A MINIMUM BALANCE.

THIS ALSO CONTRADICTS THE EXISTING LANGUAGE IN SECTION 9.08.120 WHICH MANDATES THAT ALL RESIDENTS AND BUSINESSES TO PAY FOR FRANCHISED TRASH SERVICE TO ENSURE ...'safe and sanitary treatment of solid waste...'

WHY THE FRANCHISE AGREEMENT IN ALL OF CLARK COUNTY IS NOT WORKING FOR ALL OF US:

CONFLICT OF INTEREST FOR ANYONE THAT RECYCLES!

IF YOU OWNED THE TRASH HAULING COMPANY AND THE LANDFILL, AND IT WAS CHEAPER TO THROW IT AWAY THEN TO PICK IT UP AND SORT IT, WOULD INCENTIVE WOULD YOU HAVE TO PUSH RECYCING??

NO CHOICE IN HAULER

CUSTOMER SERVICE AND CUSTOMER SATISFACTION IS NOT A PRIORITY

IN FACT, REPUBLIC RECENTLY CLOSED OUR LOCAL CUSTOMER SERVICE DEPARMENT. NOW ALL LIVE CALLS ARE TAKEN IN ARIZONA.

NO ONE IS GOVERNING THE FRANCHISEE!!!

FALSE RECYCLING RATE INFORMATION IS BEING PROVIDED TO EPA AND SNHD

NO THIRD PARTY AUDITING

VERY LITTLE POLICIES OR PROCEDURES IN ARE IN PLACE TO PROTECT YOU, THE CUSTOMER

MOST ELECTED LOCAL GOVERNMENT OFFICIALS HAVE BEEN RELUNCTANT TO DO GET INVOLVED.

DISPITE THE FACT THAT THE FRANCHISEE'S SINGLE STREAM RECYCLNG PROGRAM REDUCES SERVICE, CUTS HUNDREDS OF JOBS, ALL WHILE INCREASING RATES:

FUNDING FOR CURBSIDE RECYCLING ACTUALLY BEGAN WITH A RATE INCREASE OF $1.25 PER HOUSE AND 18% INCREASE TO BUSINESSES IN 1991. BUT PER AN AUDIT PERFORMED BY CLARK COUNTY YEARS LATER... THE REVENUE WAS MYSTERIOUSLY, AND WITHOUT APPROVAL, 'BLENDED' INTO THE RATE STRUCTURE INSTEAD OF BEING HELD SEPARATELY TO FUND RECYCLING INITIATIVES ONLY.

PER AN AUDIT PERFORMED BY CLARK COUNTY IN 2013… ‘ so, although the increase was granted on the condition that a recycling program was implemented… the increase was blended into the rate structure and considered part of the overall revenue in future agreements…

THIS AMOUNT NOW EXCEEDS $3 MILLION DOLLARS PER MONTH IN REVENUE FOR THE FRANCHISEE, YET PRICING WILL NOT BE DECREASED EVEN THOUGH THEY ARE RECEIVING REDUCED SERVICES.

NEVADA'S RECYCLING RATE IS STILL DISMALLY LOW – INCLUDING AREAS WHERE THE PROGRAM HAS ALREADY BEEN INSTITUTED,

CLARK COUNTY: CLAWBACK CLAUSE:

ON JUNE 30TH, 2017, IF SINGLE STREAM PROGRAM IS DEEMED UNSUCCESSFUL, THE NEW FRANCHISE AGREEMENT contains LANGUAGE THAT WILL ACTUALLY INCREASE PICKUP FEES BY $4.27 PER HOUSEHOLD TO RETURN THE SERVICE TO WHAT YOU HAVE NOW.

THE APPROVED LANGUAGE FROM 11/2013 DOES NOT INCLUDE AN AUTOMATIC RATE INCREASE. IT REFERS TO A RATE INCREASE THAT WILL APPROVED AND THAT TAKES INTO CONSIDERATION ‘AN ECONOMIC ANALYSIS’

RATE INCREASE LANGUAGE WAS ADDED 9 MONTHS AFTER THE ORIGINAL MOTION WAS PASSED AND INCORPORATES AN INCREASE OF $4.27 PER HOUSEHOLD. AT 300,000 HOUSEHOLDS, THAT IS $1,281,000 P/MONTH!

THE INCREASE AMOUNT WAS BASED ON AN ‘AUDIT’ BY A THIRD PARTY. THAT SAME THIRD PARTY STATES IN THEIR REPORT THAT '... They did not conduct an audit, as they relied entirely on Republic's self reporting...' !?

THE FRANCHISEE IS MISUSING ITS PRIVILEGES AWARED TO THEM THROUGH THE FRANCHISE AGREEMENT TO DRIVE SMALL AND FAMILY OWNED BUSINESSES OUT OF BUSINESS.

COMMERCIAL RECYCLING IS ONE OF THE ONLY OPEN MARKETS IN CLARK COUNTY. REPUBLIC'S EQUIPMENT, TRUCKS, FUEL, PARKING, FACILITIES (INCLUDING THE NEW RECYCLING FACILITY) AND ALL OF THE ADMINISTRATIVE EXPENSES ARE PAID FOR THROUGH THE SAME COFFERS AS THE FRANCHISED SERVICES.

THEY ARE USING THEIR OWNERSHIP OF THE LANDFILL TO UNDERCUT COMPETITION IN OPEN MARKETS.
