Urgent Request for Special Meeting

I, the undersigned homeowner of Bethany Trace, hereby petition the community to call a Special Meeting of the Homeowners for the exclusive and urgent purpose of electing a new Board of Directors (BOD).

The Bethany Trace community is currently operating without an active or functional Board of Directors. As per our governing documents, and to ensure the proper management and fiscal health of our community, this situation requires immediate remedy.

The Necessity of an Effective Board of Directors

An effective Board of Directors is essential for the following reasons, directly impacting the value, safety, and quality of life in our neighborhood:

  • Financial Stability and Oversight: The BOD is responsible for managing the HOA's finances, approving the annual budget, setting and collecting assessments, and ensuring proper reserves for future maintenance and repairs. Without a board, these critical financial operations are jeopardized.
  • Maintenance and Common Area Upkeep: The board oversees the maintenance, repair, and replacement of all common elements (e.g., landscaping, pools, clubhouses, roads). A lapse in oversight can lead to property deterioration and increased future costs.
  • Covenant Enforcement: A functioning BOD is necessary to consistently and fairly enforce the community's Covenants, Conditions, and Restrictions (CC&Rs), which protect property values and maintain neighborhood standards.
  • Legal Compliance and Liability: The board ensures the HOA complies with all federal, state, and local laws, and takes necessary actions to protect the HOA (and thus the homeowners) from potential legal liabilities.
  • Community Planning and Decision-Making: All important decisions regarding the future of our community, from capital improvements to vendor contracts, must be made by an elected body representing the homeowners.
