Background:

Issue Identification

The Forests at Inwood HOA BOD is trying to transfer billing and collection of trash collection fee from the HOA to C-6 without reducing the quarterly property assessment by the amount of trash collection fee included in the assessment.

2. Background

2.1 BOD issued a special meeting notice 20-Jan-2014 to be held 4-Feb-2014. The

BOD expressed concerns about the level of reserve funds and blamed the problem on mismanagement of trash fees. It proposed an increase of quarterly assessment of $75 to help remedy the perceived problem.

2.2 Several residents produced evidence refuting the BOD claims.

2.3 On 31-Jan-2014 the BOD issued a letter acknowledging some problems with its findings but urged residents to attend the 4-Feb-2014 meeting to "help us make our budget more secure."and to correctly raise the HOA assessments by a super majority of votes.

2.4 Attendance at the 4-Feb-2014 meeting coupled with proxies did not meet quorum required by DCCR. HOA assessments were not raised.

2.5 The BOD issued an undated, unsigned newsletter on or about 24-Jun-2014 declaring that effective 1-Jul-2014 trash collection fee for residents would be billed by and paid to C-6 and that the property assessment would remain unchanged at $189.89 per quarter. This violates the rule to raise rates >10% without vote.

Action taken by the BOA promulgated in its 24-Jun-2014 newsletter concerning property assessment and trash collection violates the HOA DCCR.

5. Recommendations

5.1 The BOD reduce the quarterly property assessment by $61.60 to $128.29.

5.2 The BOD reconsider the plan for assessments and reserves proposed by Roy Hooks 5-Feb-2014.

The undersigned members ofThe Forests at Inwood Homeowners Associationhereby serve notice that we do not accept the Board's action concerning assessments as promulgated in the Board's 2014 summer newsletter subsection referencing Trash Collection Service.

We accept termination of trash billing by the Association. We will reduce payment of quarterly property assessment from $189.89 to $128.29 (189.89-61.60). Current amount of trash fee included in HOA quarterly Assessment is $61.60.

We support funding Reserves according to our DCCR and generally accepted accounting practices. We recommend the Board reconsider the plan proposed by Roy Hooks in February 2014 for managing reserves; however, we will accept any plan that provides for Association member monitoring and approval of disbursements for capital improvements. We offer to help draft plans and procedures to ensure future continuity in managing operating budget, reserve funds, and neighborhood maintenance.
