Heather Glen Homeowner Association Board of Directors: May 21, 2023 We, the homeowners of Heather Glen and hereby signed below are submitting this petition to make an official demand for repair of our amenities and common areas within the Heather Glen subdivision. The many ongoing and serious problems with the care and upkeep of the amenities are cause for concern given that this is a new community and still under development.

Pool and pool maintenance:

    • The pool is currently out of order as of May 17th as we understand due to cracks in the flange on the filtration system. Is the epoxy and caulk a temporary fix to a bigger issue?
    • The pool also had to be shut down last year during the summer months for pump issues and water quality issues.
    • We have gone through several pool maintenance companies that fail to properly maintain the pool and the pool equipment, which in turn directly affects our ability to use the amenities that we are paying for.
    • 2022-closed 16 days
    • 2023-closed 8 days and counting
Spa/Hot tub
    • The spa has been closed until today waiting for a heater that has been on order since last year. It is our understanding according to the management company newsletters that the heater was just replaced last year
    • The spa is broken far more than it is operational.
    • Again, we have replaced pumps and heaters and gone through contractors that fail to properly maintain the equipment and water for the amenity to be available and safe for use by the homeowners.
    • 2022 closed for 77 days
    • 2023 closed 122 days

Fountains and ponds

    • Many ponds are missing fountains that have been pulled for repairs or have never had fountains installed as promised to homeowners by sales staff at time of purchase.
    • We have been told by the management company that electrical boxes needed to be corrected/repaired and then all fountains would be re-installed, but this has not happened.
    • The fountain in the main pond behind the clubhouse was removed for repair over 3 months ago and has yet to be reinstalled.
    • The last update on fountains we received was on March 17, 2023, in the weekly newsletter, which listed five fountains out for repair or meters that needed repair.
    • Many of the ponds are overrun with algae, the water level in many of the ponds is low, creating a perfect breeding ground for algae to grow very quickly, clogging the few fountains still operable and creating the perfect breeding ground for mosquitoes, which are known to transmit West Nile Virus.
    • Have cage/traps have been considered to protect the fountain pumps from foreign debris.

BBQ grills and fire pit area by the pool

    • One of the grills has never worked and another has been out of order for months.
    • We have been told by the management company that the grills were to be replaced back in March.
    • We don’t understand how it takes months to replace a grill.
    • Our weekly newsletters have stated they are set to be replaced in 1-2 weeks for over a month now.

Fitness center

    • We have been informed by the management company that a new vendor was hired to maintain and repair/replace any broken equipment in the fitness center.
    • However- we have broken equipment that has been out of use for weeks and has not been replaced.

Vandalized areas

    • In January our community was vandalized by a guest staying with a homeowner.
    • The person was caught and charged by police but over five months later, we are still waiting for repairs to our main mailbox kiosk and the doors to our clubhouse.
    • There has been no communication from the management company about the timeline for these repairs to be completed.

So called Nature/Natural Areas

    • We have been informed that these areas will not be cleared/cleaned or maintained by the landscape company pursuant to HOA directives.
    • Some of these areas were never cleared to begin with and have dead and fallen trees and debris, creating an eyesore in our community,
    • It is important to the overall aesthetic of the community that these areas are cleaned up.
    • What is the rationale for not maintaining these areas? Sprinklers and maintenance of the children's playground area
    • There are multiple areas where the sprinklers are not running, and the areas are quickly becoming dead grass that border our yards.
    • These issues have been communicated to the management company, yet we receive broad statements that the landscape company is working on it.
    • There are bee/wasp/hornet nests on the playground equipment and some children have been stung.
    • This is something that should be addressed with the grounds maintenance company to ensure the safety of our children in the community.

Clubhouse Repairs/Transition to HOA

    • We are requesting transparency with the “punch list” of what is slated to be fixed prior to the clubhouse being signed over to the HOA.
    • We are requesting that if we see additional repairs not on the “punch list” that we are able to add them.
    • We are requesting an update of the status of the repairs and status of the timing of the transition for the clubhouse to be signed over to the HOA.

Open Communication

    • We the homeowners understand that this is still a developer-controlled community, however all homeowners deserve open and honest communication with the HOA Board.
    • At the annual meeting, no interactive communication was permitted during the virtual meeting and questions posted or submitted previously went unanswered.
    • As homeowners we have the right to be informed of decisions to expand the community and a potential build to rent community that will have access to use our already overburdened amenities.

As homeowners, we purchased our homes from DR Horton chiefly because of amenities that were touted by the sales staff. We have chosen this community as our home, and we are asking that the HOA Board evaluate the serious and concerning issues stated above and move swiftly to resolve them.

The homeowners at Heather Glen are formally requesting a response to this petition in a timely manner that will detail a timeline for the repairs to our amenities as well as full transparency concerning future development plans by DR Horton that have a direct impact on our community.
