Allow Reasonable Fence Placement
We are petitioning the Pondview HOA's Board of Directors to allow for maximum flexibility on fence placement on a homeowner's lot. This community is made up of three types of homes (Villas, Townhomes, Single Family) with dozens of different floorplans and footprints, lot sizes and shapes, in which a "one size fits all" interpretation of the by-laws is not feasible. Fences approved for installation throughout the community should be allowed to be reasonably placed at any point along the side of a homeowner's house, so long as the fence is not installed further forward than the front corner of the house footprint, not to include porches or other add-on's.
Allowing homeowners to determine the best placement for their fence to allow for maximum protection of access points, HVAC systems, basement walk-outs/egress, windows, and other areas is of utmost importance. Fence placement due to yard gradient, previously approved projects, etc will also be determined by the homeowner and the fence installer.
This agreed-upon interpretation of the current by-law regarding fence placement being "rear yard only" will ensure that the by-law will not need to be updated at this time, and remains harmonious with all fences currently installed throughout the community.
Upon receipt of signatures from the majority of homeowners, this agreed-upon interpretation will be immediately implemented.
