A Special Meeting of the ESH HOA is being requested in accordance with ESH HOA BYLAWS: Article II - Section 3. Special Meetings:
. . . it shall be the duty of the President to call a special meeting of the Association if so directed. . . . upon a petition signed by at least twenty-five percent (25%) of the Total Association Vote. The notice of any special meeting shall state the date, time and place of such meeting and the purpose thereof. No business shall be transacted at a special meeting, except as stated in the notice a petition signed by at least twenty-five percent (25%) of the Total Association Vote requesting the Board of Directors to call a special meeting on behalf of the homeowners.
The purpose of this meeting is to:
(1) Declare the Updated Design Guidelines dated April 2, 2023 “null & void." All covenant changes properly and lawfully implemented in accordance with ESH PROTECTIVE COVENANTS: Article XII - General Provision: Section 4. Amendment:
. . . . this Declaration [of Protective Covenants] may be amended upon the affirmative vote or written consent, or any combination thereof, of Owners of at least two-thirds (2/3) of the Lots. . . and
(2) Require ESH Board transparency to report on financial/decisions negatively impacting your money/HOA investments.
