The Brixworth CCR's state:

Article IV: Section 17: Recreational Equipment: All playground and recreational equipment must be used, erected, placed or maintained to the rear of all Lots. Wood construction for such equipment is encouraged. No metal play equipment is allowed. Portable basketball goals must be stored out of sight when not in use.

Article VII: Section 3: Duration and Amendment: ...this Declaration may be amended by the affirmative vote of at least three-fourths (3/4ths) of the votes of the Owners.

Basketball is an activity which requires a goal to constantly be up and ready whenever our children wish to play. Some homeowners who have basketball goals have children who wish to one day play competitively. This means they will be out practicing every day. As busy parents, we can't always stop what we are doing and simply don’t have the time to set up the goal each time our children want to play or practice. These portable goals are too heavy and awkward for young kids to move and maneuver into place on their own. When set up correctly (with water or sand in the base) it is even difficult for an adult to move them, especially through grass.

Basketball also needs a large hard surface around the goal to bounce the ball. Our driveways are the perfect place to do this. Very few backyards come with a concrete surface large enough to enjoy this sport. The cost alone to install such a surface puts this activity out of the reach of many homeowners.

Basketball goals certainly do not take away from the value of our homes, but add a great deal to the community. Brixworth is definitely an upscale neighborhood. When looking at other neighborhoods in the area that are comparable to ours, you will see basketball goals throughout the community.

Basketball is a great source of exercise and gets kids outside away from electronics. The sport also teaches teamwork and sportsmanship. Having this activity readily available gives kids something positive to do while creating unity and friendships within the neighborhood. This restriction on portable goals seriously detracts from allowing our kids to enjoy such a great sport anytime they wish.

It’s outrageous that portable or in ground basketball hoops cannot be left in place. There are so many kids in the community. Families with kids looking to move to the area look for basketball hoops, back yard playgrounds, trampolines, etc to see how many kids are in the area. They want their children to grow up playing outside and making a ton of friends. It does not bring down the value of homes.

Would love to keep our basketball goal in our driveway. It's to cumbersome to move back and forth all the time and the one in front of the subdivision is to far away and it's broken.

4006 Compass Pointe Ct. Let the kids have a childhood! We want to see kids playing in front of their houses. We didn't buy plastic houses.

We recently moved it the neighborhood and were very disappointed to learn of this rule, as well. Every other neighborhood we looked at before buying in Brixworth was lined with basketball goals - such an added value for kids who need to be outside.

We were unaware of this bylaw as well. Our kids have actually been earning money to help pay for the basketball goal they have been asking for. Hopefully we can get this changed!

6000 Turncreek Rd. We just moved in & we were unaware of this bylaw. One of the highlights for my daughters was having a flat driveway because we could get a basketball net. Before we moved we had a birthday party & she asked for money to buy a hoop, whiteout us knowing about the bylaw. :(
