The original developers of the La Jolla Alta community where we reside established and recorded conditions & restrictions for all homeowners to follow titled "Declaration Of Conditions." The purpose of the recorded conditions & restrictions are the "protection" of our property values and the aesthetic quality of our community through minimum standards of beautification. The property owner of 1533 Calle de Primra was required to obtain approval for the "type, design, materials, heights and locations of the fence they have proposed to install before commencing the work. This petition is to disapprove the chain link fence proposed by the 1533 Calle de Primra owner. Specifically, 1) the chain link material is a down grade to the aesthetic beauty the Declarations OF Conditions were created to protect, and 2) the fence height is inconsistent with what exists throughout the community and may also violate the City of San Diego building code. Furthermore, this petition shall provide the Architectural committee the necessary documentation to require the 1533 Calle de Primra owner to remove the unapproved partially built chain link fence and to submit an alternate design that will be equal to or an upgrade to what the developer originally installed for the affected neighbors approval.
