On the eve of the U.S. Government hitting a record $40 trillion in public debt, Avi Loeb – a Harvard professor who has reportedly become isolated from mainstream science due to his repeated, controversial suggestions that astronomical objects may represent alien spaceships – announced he had been designated by the U.S. Government to form a “UAP Science Advisory Council” to provide outside advice to the government about UFOs.

Following that announcement, those appointed to this body began referring to the occurrence of unannounced meetings, and describing the adoption of formal, collective resolutions (see, for example). Loeb, himself, has repeatedly characterized the body as formed at the direction or instigation of the U.S. Government and operating in cooperation with it.ⁱ

The Federal Advisory Committee Act (FACA; 5 U.S.C. §§ 1001–1014) is clear: if the U.S. Government establishes or utilizes an outside group of experts for purposes of giving collective advice or recommendations it must file a charter, adhere to open-meeting and public access requirements, announce its meetings via the Federal Register at least 15 days prior to each, and have a Designated Federal Official responsible for it, among other requirements. Important among those other requirements for present purposes is viewpoint balance; however, in respect of the alleged council, The Guardian described it as principally formed of persons “with apparently similar minds” to Loeb.

Despite Loeb’s repeated characterizations, it is unclear if this is actually a U.S. Government-authorized or solicited body. To date:

• No named, federal official has given any statement to the mainstream media affirming its existence;
• The body is mentioned in no Federal Register notice, in no statutory or regulatory text, and on no .gov website;
• A website purporting to be that of the body operates on a .com domain and its content is largely limited to a rotating carousel of Avi Loeb promotional videos.

Nonetheless, the members of this group continue to pantomime the actions of an actual federal advisory committee, enacting collective resolutions, referring to cooperation and consultation with federal agencies, and indicating their official status.

If the government established or utilizes this body, its apparent noncompliance raises FACA concerns; if this is a private group presenting itself as having official federal authorization or affiliation, the concerns are potentially greater.

We, the undersigned, respectfully call upon the Office of the Director of National Intelligence (ODNI) to either (a) confirm this is a private body formed without ODNI solicitation and upon which ODNI does not intend to place any reliance on for advice, (b) bring this entity into FACA compliance, or, (c) cease utilizing or representing the body as a federal advisory entity.
