The determination of whether or not a permit is required seems vague per the following link

At the very least I believe Theo’s should be able to make an application to have their art approved and to modify it to be in compliance rather than be required to remove it entirely.
The city has an opportunity to demonstrate goodwill to a merchant who is a good neighbor to the neighboring community.
