CONCERNS REGARDING THE PROPOSED 36-UNIT
APARTMENT DEVELOPMENT

TO: MAYOR AND MEMBERS OF BAYHAM COUNCIL
We, the undersigned residents and concerned members of the Eden community, respectfully
request that Bayham Council carefully review the proposed development of two two-storey
apartment buildings containing a total of 36 residential units at 11470 Plank Road, Eden,
before making a final decision on Official Plan Amendment OPA-03/26 and Zoning By-law
Amendment ZBA-07/26.
We support responsible and appropriately planned growth in Eden. Our concern is whether
this particular proposal, at this scale and location, can be appropriately serviced, safely
accommodated, is compatible with its surroundings, and represents good planning for the
community.
WE ASK COUNCIL NOT TO APPROVE THE
AMENDMENTS IN THEIR CURRENT FORM UNLESS
AND UNTIL:
1. WASTEWATER CAPACITY IS DEMONSTRATED
Bayham has identified wastewater servicing capacity as an important consideration for
development in Eden.
We ask Council to establish:
● the wastewater capacity currently available to accommodate additional development;
● the capacity required for this proposed development;
● whether capacity has been accounted for in relation to this application; and
● the cumulative impact of this development together with other active, approved or
proposed development in Eden.
2. GROUNDWATER AND PRIVATE WATER SUPPLY ARE
DEMONSTRATED TO BE ADEQUATE
The proposed development relies on private water.
We ask Council to review the applicant’s hydrogeological evidence, including groundwater
testing, neighbouring-well monitoring and peer review, and determine whether the proposed
water supply can reliably provide adequate potable water for 36 residential units without
unacceptable impacts on surrounding properties and wells.
3. ALL SERVICING REQUIREMENTS ARE CLEARLY ESTABLISHED
Before approving the requested amendments, Council should identify:
● required water and wastewater capacity;
● any servicing allocation;
● required infrastructure improvements;
● associated costs and responsibility;
● required approvals; and
● conditions that must be satisfied before development can proceed.
4. THE PROPOSAL REPRESENTS GOOD PLANNING
Council should determine whether the requested Official Plan and Zoning By-law
amendments are appropriate and:
● conform with the applicable County of Elgin Official Plan policies;
● are consistent with the Provincial Planning Statement, 2024, where applicable;
● appropriately address Bayham’s newly adopted Official Plan;
● appropriately address applicable servicing policies;
● support an appropriate form and density of residential development; and
● appropriately consider the cumulative infrastructure needs of Eden.
5. TRANSPORTATION AND ACCESS ARE APPROPRIATE
Council should review the applicant’s traffic and access information and the comments of the
appropriate municipal, County and road authorities regarding:
● traffic generation;
● site access;
● sightlines;
● road capacity;
● pedestrian safety;
● vehicle movements; and
● emergency access.
6. STORMWATER AND DRAINAGE ARE APPROPRIATELY ADDRESSED
Council should ensure that appropriate engineering and stormwater management measures
are in place to address:
● grading;
● drainage;
● runoff;
● erosion;
● stormwater management; and
● potential impacts on neighbouring properties.
7. THE SCALE AND DENSITY ARE APPROPRIATE FOR EDEN
Council should carefully consider the proposed 36 residential units on approximately 1.36
acres, including the proposed density and building form, in relation to:
● surrounding properties;
● existing development;
● other active or planned development in Eden;
● infrastructure and servicing capacity; and
● the character and planning objectives of the community.
8. SITE DESIGN AND NEIGHBOURING IMPACTS ARE ADEQUATELY
ADDRESSED
Council should ensure that appropriate consideration is given to:
● building setbacks;
● building height;
● lot coverage;
● landscaping;
● buffering;
● privacy;
● lighting;
● noise;
● parking;
● snow storage;
● internal circulation; and
● the relationship of the proposed buildings to neighbouring properties.
OUR REQUEST
We respectfully ask Bayham Council to:
DEFER a decision on Official Plan Amendment OPA-03/26 and Zoning By-law
Amendment ZBA-07/26 until Council is satisfied, based on appropriate technical
evidence and planning analysis, that the proposed development can be appropriately
serviced, safely accommodated, is compatible with its surroundings and represents
good planning for Eden.
If those requirements cannot be demonstrated, we ask Council to DENY the requested
amendments in their current form.
We further request that Council:
● fully consider the technical studies and agency comments associated with the
application;
● consider the cumulative impact of development on Eden’s infrastructure and
services;
● make publicly available, where permitted, the technical information relied upon in
making its decision; and
● give full consideration to this petition and all individual written submissions received
from residents before making a final decision.
OUR POSITION
We are not opposed to responsible growth or additional housing in Eden.
We are asking Council to ensure that growth occurs in a manner that is:
appropriately serviced • safe • sustainable • compatible with the surrounding
community • and consistent with good planning.
We respectfully request that this petition be received by Council and placed on the official
planning file for:

Its a hamlet area, should not have apartment buildings. Concerned about water supply and increase in traffic
We need commitment and open studies on how the infrastructure is going to maintain current and future growth without pushing costs on residents. Water and sewer issues. Available school ing for new residents? Currently not zoned for apartments if passed will this allow the other areas requesting development the opportunity to do the same.
Ground water concerns, infrastructure in general, the loss/appeal of a quaint village
Building needs to slow down. We originally moved here for the small town village. Infrastructure is also a major issue here.
Due to lack of infrastructure in this tiny hamlet.

I am concerned whether the water waste system that we currently have especially in Port Burwell is enough to handle the 36 unit purposed.
Its a hamlet area, should not have apartment buildings. Concerned about water supply and increase in traffic
We need commitment and open studies on how the infrastructure is going to maintain current and future growth without pushing costs on residents. Water and sewer issues. Available school ing for new residents? Currently not zoned for apartments if passed will this allow the other areas requesting development the opportunity to do the same.
