ASU Residents for 1st Amendment Rights

As residents of ASU Residence Halls, we feel that the policy on page 37 and 42 of the Residential Life Student Handbook stating, “clothing, banners, flags, lights, or messages may not be hung in or posted on the windows or outside of the buildings” is in need of reevaluation. At its core, the policy unfairly and illegally restricts the 1st amendment freedom of expression of ASU residents. According to the United States Supreme Court in Tinker v. Des Moines, “undifferentiated fear or apprehension of disturbance is not enough to overcome the right to freedom of expression.” The interpretation of the policy to ban all window items in order to prevent offensive speech directly interferes with this precedent.

We find the current justification for the policy patently oblivious to the Residential Life Handbook as well as constitutional law. Page four of the handbook states, “ASU is committed to academic freedom and free speech. Respect for these rights requires that the university tolerate diverse and sometimes offensive expressions of opinion.” We agree with this statement and contend that the existing window policy is in direct violation of this principle developed by the ASU Campus Environment Team.
