The case against ten defendants including eight police officers accused of fabicating the case against the cardiff three collapsed because it was claimed that important evidence had been shredded. Since then the evidence has been found, yet there seems to be a reluctance for a retrial/continue with the prosecution. As the law stands in England there is very little to stop the CPS ordering a new/continued prosecution of the ten defendants, and not to do so will only encorage police officers to fabricate evidence against other innocent people. Concerning the somewhat weak excuse that the lost/found evidence benifitted the defence and therefore cannot be used as "new evidence found which justifies a retrial". Well said evidence has not been released, and until it is it can be said that it is "possibly new evidence for a prosecution". If when released it is found that the lost evidence could not be used to form a good defence. Then in effect the evidence becomes prosecution evidence ie if defence evidence is weaker than expected then it helps the prosecution. Of course if the missing lost evidence is released and found to be strong defence evidence, then after verification by non corrupt (agreed to be non corrupt by all parties) examiners to make sure it had not been falsified. There would then be reasonable cause to dissqualify the possibility of a fair retrial.
