    Comments: On 10th October 2012, the Judge of Southern District of Newyork (Your Honor Judge Sean H. Lane) signed the POR approving the bankruptcy plan filed by the Terrestar Debtors. This is the second time the debtors undervalued the Terrestar assets significantly for their own vested interests. First, the Terrestar Debtors undervalued highly valued 2.0 GHz spectrum and now they played the same game to undervalue the 1.4 GHz spectrum. The debtors were in clear violation of bankruptcy laws multiple times. There are many wrong doing occurring in the bankruptcy process of this company, to benefit the preferred shareholders, note holders, lawyers, insiders and its executives. Instead of looking for buyers, it chose to file bankruptcy, and break up the company's assets into two separate Below are some violations that were highlighted in our common shareholder petitions and objections ----- 1). Violation of Fiduciary Responsibility ----- 2). Securities Fraud and multiple violations of the Sarbanes-Oxley Act and in real need to maximize the value of the estate, such as finding "new value" ----- 3). Constructive Fraud - Violations of Title 18 Section 152, Section 154, Section 157 and Section 158 in Bankruptcy Crimes ----- 4). Undervaluation of FCC licensed 1.4 GHz spectrum ----- 5). Questionable management and insiders dealing ----- 6). Questionable favorable lease agreement to the insider, Harbinger ----- 7). Clearly questionable asset valuations - Asset valuations were inflated and deflated at varies time to favor their circumstances ----- 8). Two separated bankruptcies ----- 9). Why file bankruptcy at Southern District Court of New York? Even when they are a Delaware, Corporations and jurisdiction. ----- 10).     Comments: terrestar corp ran their company as a private company not informing investors of problems with the phone.very crutial information.terrestar.com-support-urgent customer bulletin...the phone didn't work.they have been very shady and disrespectful to the public investors.They also have no respect for the court to not even allow the court to finish making its ruling by assuming the go ahead to apply for new commonstock with the sec.Please overturn the third ammended plan and include commonshareholders.Thank you Judge Lane .Sincerely Dan Pacaud

    Comments: I am an owner of 120k shares and a stockholder since 2008. The valuation of the 1.4 spectrum as presented by the Debtors can not be accurate as it is only the valuation of one opinion. That opinion can be flawed, may have over looked some viability both current and down the road, and could have been funneled so that only the view that helped the Debtors' cause was presented. The RFK report contradicts two key assertions, that of the spectrum's limited use, and the other that it is not viable in the use of wireless communications. Those contradictions alone warrant that the Blackstone assessment is flawed coupled with the fact that, to my understanding, the assessment also predates and incorporates the Lightsquared contract for its usage into the equation. The common shareholders were not represented fairly as the common shareholder was both denied a voice in the vote (even though we collectively held hundreds of millions of dollars in the company pre-bankruptcy) and were also denied our own voice of appraisal through an independent examiner. Since liens were also taken out against that of the shareholders' investment in this company, does that not also give us a right to be a part of its future down the road?

    Comments: To The Horable Judge. I am asking for you to please Grant Our Appeal. I am 19 years of age, my mother started this account for me in 2009, with the Survivor benefits that I received becuase my father has passed away from Heart failure. My mother researched Terrestar, that is was going to launch Satelites, It owned Spectrum, It was going to produce the Genus phone that would be both a satelite phone and a cell phone. She believed that this stock would make me enough money to attend college. Well needless to say it did not, and I was not able to attend college. My dreams of being a cardiac/thoraci surgeon completely came to an end on October 10. I use to believe in the judicial system, that it stood for Honesty,ethics, and to protect the innocent. It is suppose to put criminals in jail, well they are a criminal they stole my money along with many more innocent peoples hard earned money. They therefore need to be reprimanded to jail for theft by deception. Please Your Honor, Grant this appeal based on the honest, ethical and innocent investors. Please hear our pleas.

    Comments: Terrestar Corp has lied to their investers many times,disreguarded phonecalls and emails prebankruptcy.The business plan of the terrestar genus (the first smartphone to use satelite and a carrier i.e at&t) did not work.They never updated investors of progress.Doing some research on my own i have discovered that on the website, www.terrestar.com ,under support,URGENT Customer Bulletin-dated May 8th,2012.It reads-During recent testing,it was determined that a problem exists with a genus phone feature that will cause the phone's boot-up process to fail.As an investor this is important and vital information terrestar withheld.The maker of the phone electrobit had a claim against terrestar in court.They were the largest unsecured claim and were on the common side opposing the confirmation of the terrestar restructuring plan.Well the tables have turned and Electrobit has settled for half of their money and now support the restructuring plan.We the common shareholders have lost all our rights in this case and are being stepped on with no representation .Please help us.Sincerely Dan Pacaud.

    Comments: Your Honor, please here our pleas. I am a single mother on SSI, I invested in Terrestar becuase I believed they had a good product the satelite and wireless phone. They were launching satelites, and they owned spectrum. I bought this stock for my daughter with her survivor benefits becuase her father had passed away. I needed a way to invest her money to make her money so she could attend college. My daughter presently cannot attend college as the income I receive from SSI is below poverty level, which makes me ineligible to co-sign loans for her to attend school. She presently works 2 jobs to try and save to attend school, but with the cost of a higher education she will have to work for 15 years before she would be able to pay for it. They have stolen my daughter's future, they have stolen her education.

Their bankruptcy has now passed down to me, because they have stolen my money, if commons are wiped out, I will loose my home, becuase recently I lost a contract that was my bread-n-butter, and to top it all off, my investment is gone.
