Petition to Walmart Stores Inc.,

We the undersigned hereby demand the reinstatement Mark Stevens employment as a part-time associate, with back pay from November 11, 2012, in a store of his acceptance, with a position and schedule of his acceptance.

Further to this we demand that Walmart Stores immediately improve the company’s Open Door policies to insure situations such as the one described in detail below are fully investigated and acted upon by a neutral party.

Background:

Mark Stevens was a part time overnight Customer Service Manager with Walmart Stores Inc., in their West Omaha location for ten years.

After a change in store leadership, the new management team began a program of forcing tenured associates either to transfer out to another store or quit. In Mark’s situation, prior store leadership permitted him to keep his legacy schedule part time of 11pm to 3:30am with Fridays & Saturdays off to avoid conflict with his full time employment. This was allowed not only due to Mark’s excellent record which included a number of awards.

To this end, store management began a program to bully Mark into changing his schedule across a two year period beginning in 2009.

Additionally the store’s management team failed to respond to numerous open door complaints that other employees in the store called him “gay” when in fact he is not. A cashier that was under Mark’s supervision went so far to ask one night, in the check out line, “now that Obama is for gay’s, since you’re gay you’ll become a democrat, right?”

Management refused to follow up on this cashier’s harassment of Mark.

Management team of this store also used Mark’s living situation in 2012 to force him to change schedules or face losing his job, part time income, and becoming homeless. Mark was illegally evicted from his home of 15 years in Arlington, Nebraska, and forced to take temporary residence in a room renting for over $700 a month in Omaha.

Numerous times over the last five years of his employment, Mark attempted to apply for advancement into other positions, namely Accounting Office, where he has not only education in Accounting, but handled the accounting and banking for his family’s business for over 10 years before leaving.

Lastly in late October 2012, Mark was instructed by Management, in violation of Walmart’s own ethics rules, that an overnight cashier’s review he was writing must be at a meets or above rating, when in actually this cashier should have been in progressive discipline.

Management further threatened Mark with coaching if he did not follow their direction.

At the same time in October 2012, Mark again reported management’s behavior via letter to the Home Office in Bentonville, and has attempted many times since that point to get individuals at the Home Office level to discuss, investigate, and resolve these issues.

On September 18, 2012, Walmart’s Ethics staff responded that since Mark was no longer employed by Walmart, they could not investigate the issue and kicked it back to where the root of the problem in this store exists, at the local and regional Market District level.

These behaviors should have been caught by the Market District Manager, who has since moved on, or the Regional Market District Manager.
