Virginia Castle Doctrine/Stand Your Ground Law

As I read and watch the news everyday in Virginia, and the rest of the United States, the home break-ins, and other crimes is tremendous. Its time for us law abiding citizens to take a stand and protect our family, friends, and property. This petition is going to be sent to all politicians in Virginia to adopt the Castle Doctrine Law/Stand Your Ground Law that Florida, North Carolina, and other states have put into operation. In short, it gives rights back to law-abiding people and forces judges and prosecutors who are prone to coddling criminals to instead focus on protecting victims.

The Castle Doctrine is made up of the following 4 parts.

1.It establishes, in law, the presumption that a criminal who forcibly enters or intrudes into your home or occupied vehicle, is there for only one purpose; to commit an overt crime against the victim, and  to cause death or great bodily harm to prevent the crime from being reported; therefore a person has every legal right to use any manner of force, including deadly force, against that person without having to wait for a second overt act to be committed against them; by which time it could be too late.

2.It removes the "duty to retreat" if you are attacked in any place you have a right to be. You no longer have to turn your back on a criminal and try to run when attacked. Instead, you may stand your ground and fight back, meeting force with force, including deadly force, if you reasonably believe it is necessary to prevent death or great bodily harm to yourself or others.

3.It provides that persons using such force authorized by law shall not be in fear of being prosecuted for using such force.

4.It also prohibits criminals and their families from suing victims for injuring or killing the criminals who have attacked them.  The intruder committed a crime against the victim, and the victim has every right to protect themselves, family, and property if the walls of their home, or property have been breached.

Therefore, we the undersigned Citizens of the Commonwealth of Virginia do hearby ask the Government of Virginia to pass said Castle Doctrine/Stand Your Ground Law, or bring this petition to a special election vote, and allow the citizens of Virginia to decide this matter.

  • Stephen DeWeese should include provisions similar to Indians.

Last year, Indiana became the first and only state to enact an NRA-backed law that specifically allows civilian force against law enforcement officers and other “public servants” when they are engaging in “unlawful activity.” The statute came in response to a court ruling that held the exact opposite – that individuals could not use deadly force to protect against a police intrusion, even if they questioned the legality of the intrusion.

The law authorizes “reasonable force” against any unlawful entry or trespass by police, and even deadly force to prevent serious bodily injury and what the shooter deems unlawful activity. While the allowance for deadly force is narrow, it still provides a citizen with an essential fundamental right of protection.

For those who do not think this is necessary I advise you to go to "YouTube" and watch police murdering innocent civilians. The videos number in the tens of thousands, next watch police tazer videos and again you will see police murdering civilians and "high fiving" each other over there actions.

Yes Virginia needs a Castle Doctrine but should include the right to protect themselves from any ILLEGAL ACTION that threatens harm.
