Name: William King on Jan 24, 2010City: Ceader ParkState: TXComments: Under the United States Constitution, Article 1., Section 8., Clause 3 under the powers reserved to Congress: "To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes;" This means the BATF would have the right to regulate and arrest individuals selling firearms to individuals that are residents of other states, or illegal immigrants. The BATF would not have the juristiction to regulate the sale of private firearms to legal citizens of Texas, as they are a arm of the Federal Government. The Austin PD, should not regulate the private sale of firearms as well. Under the Gun Control Act of 1968: "Private sales between unlicensed individuals who are residents of the same state are allowed under federal law so long as such transfers do not violate the other existing federal and state laws. While current law mandates that a background check be performed if the seller has a federal firearms license, private parties living in the same state are not required to perform such checks under federal law. State laws however can prohibit such sales." "A person who does not have a Federal Firearms License may not be in the business of buying or selling firearms. Individuals buying and selling firearms without a federal license must be doing so from their own personal collection." The actions of the Austin PD and the BATF are wrong, and though I agree that illegal immigrants must not be able to purchase firearms, restricting private individuals from selling their firearms is not the answer.Flag
