Name: Jodi Johnson on Aug 31, 2003State: TXCountry: USComments: My family has called child protective services on the mother of my nephew several times only to hear that it is not a violation for a child to be raised by someone who has no permanent residence and continues to do methamphetamines. She recently had her third child (not my nephew) and he was tested at birth positive for meth. All three of her children were taken into state custody. Four days later when my brother called to get him for his weekend visit we found this information out. No one even called his father before he was taken into custody. Not only has my nephew been raised for 4 years by this woman but she now has 2 more children exposed to this situation. Now there sits a 4 day old boy hooked on meth!! I feel the system has failed to protect these children as so many more. Something must be done before more children are harmed emotionally and physically. They didn't take her two children when we reported her before because she had running water and electricity - that does not make someone a mother. I pray that someone will take control of the system and find protection for these children and the parents that are inocently harmed by the failures of our system. God bless the children!!Flag

Right now they are fighting to keep Linsey (the child) out of her biological mother's legal custody, but all the lawers say that it is rare for Texas to rule against the mother in having sole custody even if she is seen as unfit and unstable.Flag

I had twin girls out of wedlock and the father didnt want anything to do with them. Then someone said I should at least get child support to help me out. So I filed for child support and he still didnt come see them for another 2 years. When they were 3 years old he took me and my husband to court to get joint custody and visitations. My husband has been raising the twins since they were 9 months old and he wants to adopt them. The real father came to see the girls after going to court for about 2 months. It has been a year since he has seen them. but he is still paying child support. All the lawyers say that we cant go to court until he hasnt payed child support for at least 6 months. I think there should be something I could do wether or not he pays because he isnt coming around even after HE took US to court over this. He is only paying child support because if he doesnt he knows he could go to jail. So if you know anyone I could talk to or anyone that could help me with this please let me know. I too am in a similar situation like the one described above and I too did not know how violent my son's father was until after the spoke with his family only to learn that he has raped a women, abused his mother, and assulted two police officers and only God knows what else he has done. I fear for my safety and my son's so yes I will do all I can to help you change this law.Flag

My husband has to push their mother to do anything for them. She receives child support on a regular basis but yet cannot take her children to the dentist at all and leaves them home alone for 2 hours everyday during the school week. My husband has even offered to pay for the daycare and she won't discuss it. The State of Texas will do nothing until they hurt each other or someone else while being left home alone. So far they have broke a vase, a glass end table, shot at the floor with a pellet gun, and burned paper in the entryway, while left home alone unsupervised. They are 11 & 10 and their other sibling is left with them. He is 8 with ADHD.Flag

I have a record of abuse he did with the military who hide from the civilian world and now I have been without my kids for 4 yrs this up coming Mar. 6th 2000. I have been fighting ever since but the ad litem said that he is a good parent even though the kids have come to me for visits and have told me of things that he is still doing and that he has commented to them them he wishes he could have me killed so that he could make their step mom their real mother.Flag

He is involved in drugs & is not a mental or financial support to her. i just can't seem to come up with 7000.00 to start. what a shame it has to cost so much to protect your child. The backbone to our futur generation. You set out to teach your child right from wrong & in this case just because he is the birth father they consider that ok. WRONG my husband is more a father to her than he is. If at all possible you would have any advice or help please respond. Good Luck in your fight!!!Flag

With several incidences of CPS involvement with the mother. This most recent, the child went back to stay with the mother and because the new husband is wanted by the police the mother,husband and younger brother all went to stay at a hotel. Leaving my 12yr old grand-daughter behind.ALONE! The police say that they don't know who to believe. So if the mother demands that I return her home, I must do that or I will be brought up on charges. CPS really has no plans to do anything either. That's not surprising they haven't done anything with the last ten reports. Because mother is one really good lier. One time I took the child to the hospital with visiable marks and bruises. The police finally showed up after about 1 1/2 hours. Asked a couple of questions and read the child her rights. Saying that if she told them another lie they would arrest her. We never saw a doctor or anyone. They went and visited mother first and believed her story. I see the same thing happening again this time. We are in desperate need of changes in the laws in the state of Texas. The way they are now, unless the child is half dead and you can prove with out a doubt that the parent did it. They send the child back. And they call that CFlag

As a single parent of two daughters, that are now grown, they were repeatly subjected to inadequate care by their father financially, physically and emotionally. A judge had told me if I did not force my children to go with their father I would be in contempt and would go to jail. After a violent weekend with their father the children went to our neighbor because they were afraid to get me in trouble. After the children were physically hurt and threatened with a gun then CPS became involved by a report made by ou neighbor. Unfortunately CPS does not consider a report made by the parent as a valid concern. I know it's difficult to determine if parents are truly concerned about the child's well being or is this a bitter battle between two adults. It's so sad that children are put at risk and that their rights are not considered. I feel that the judicial system is a get rich scam for the attorneys and that extreme fees are not a guarantee that the childs best interest is considered. It is very sad that attorneys are also part of the system that violates childrens rights. Children need for all of us to fight for their safety and well being. I support your efforts.Flag

The laws are set up so that the courts and enforcers are protected but not the children. My ex-husband mentaly abused me and would throw things at me in frount of our children. At th ebegining of our divorce my ex told our children (ages 5 and almost 2 )that if they came near me a policeman would take me away and they would never see me again. Our son told an officer this information when she was at our home. at that time I had no idea what my now ex had stated to them. The officer got upset and repremanded him but never reported the incident. The courts were told by my ex that he had seen me both phyisicaly and mentaly abuse our children yet no invesagation was ever done, I was the primary care giver for 5 years prior to the statement and 2 years after the statements were made. My ex stated to a counsler that he used the children and the statements to get me back and the counsler never reported the abuse. So my question is why do we have laws for children that do nothing more than harm them.Flag

I do not believe in this justice system. the first judge stated my children were being abused and degrated and then less than 10 days later the next judge states its ok.Flag
