Over the last year, people from across the nation gathered in town hall meetings and exercised their 1st Ammendment Right to petition their government for a redress of grievances. They flooded the switchboards and e-mail servers at the capital. Today with all the polls running solidly against the Health Care Bill, they persist in their efforts to increase government regulation and intrusion into our daily lives. This has placed our liberties at risk. While 18 states have given their citizens the right to referendim and recall, The Texas Constitution makes no provision for recall of our elected officials. It is time We the People of Texas, lived up to our heritage and principles and demanded our right to hold our representatives accountable for their actions. Below is a petition I intend to begin circulating. It has been reviewed by a team of lawyers and is worded in legalese, so that our representatives can understand it (since they don’t seem to understand plain English). It is time we stand as Texans and fight for our liberties, I can think of no better way than this petition, to send a message to our representatives that we know our rights and are ready to fight for them.

RESOLUTION :

To all who read these presents, greetings.

WHEREAS: We the people of the State of Texas, having chosen to exercise our rights set forth and contained within the Constitution of these United States of America, under Article 1 of said Constitution which reads, “The right of the people to peaceably assemble, and to petition the Government for a redress of grievances…”, and having demonstrated exhaustively our contentions and concerns through every available means of communiqués to our elected/appointed officials, respective to an apparent and seemingly endless increase of unconstitutional governmental regulations, of which we, having found and having deemed to be intrusive to our way of life, and inviolate of the liberties prescribed and provided by said Constitution, the Bill of Right of said Constitution, and the Constitution of the great State of Texas; and,

WHEREAS: The redundant pleadings by we the people of the State of Texas, presented through and within said communiqués, have, upon a preponderance thereof, gone unheard and unrequited, and have been met with disregard and inconsideration, and this inattention by our elected/appointed officials has inferably demonstrated complete disobedience of the will of the people and/or a display of personal interest taking precedence over and above the interest of the sovereign people of the State of Texas; and,

WHEREAS: The Declaration of Independence of these United States of America does state that “…Whenever any form of Government becomes destructive of these ends, it is the Right of the People to alter or abolish it, and institute new Government, laying its foundation on such principles and organizing its power is such form as to them shall seem most likely to affect their Safety and Happiness”, and inasmuch the laws of the State of Texas do not, of present, provide for a means of resolution of such disregard nor legal recourse for same, through which elected or appointed officials may be recalled or removed from office by the people of the State of Texas, irrespective of political party affiliation;

LET IT BE RESOLVED THAT: We the people of the great State of Texas do hereby request and demand the Governor of the State of Texas to exercise the authority granted unto such office by the Constitution of the State of Texas, to call for and convene an emergency session of the Legislative Branch of the State of Texas for the purpose of providing and creating a legal means of recourse for the people to recall and recuse any and all elected and/or appointed governmental authorities who repeatedly display a blatant disregard for the will of the people and/or an unwillingness to conduct the duties prescribed unto their respective office(s) as witnessed and deemed by the people of the State of Texas.
