Support the council tenants of Camperdown to oppose financial victimization

Why should only council tenants be scrutinized to pay for dropped curbs, when legislation applies to us all?


This petition is a direct result of selective victimization of council tenants and negligence to private properties, following an apparent breach of tenancy under section 10.5.1: "You must not park a vehicle within the boundaries of your home unless there is a garage, hard standing or driveway with a properly made dropped-kerb entrance".


Additionally, tenants are also accused of violating Section 184(1) of The Highways Act, which reads: "Where the occupier of any premises adjoining or having access to a highway maintainable at the public expense habitually takes or permits to be taken a mechanically propelled vehicle across a kerbed footway or a verge in the highway to or from those premises,the highway authority for the highway may, subject to subsection (2) below, serve a notice on the owner and the occupier of the premises—


a)stating that they propose to execute such works for the construction of a vehicle crossing over the footway or verge as may be specified in the notice; or


b)imposing such reasonable conditions on the use of the footway or verge as a crossing as may be so specified.”


Therefore, by signing this petition you agree that subject to the local authority's tenancy agreement, section 10.5.1 has been breached. However, under the conditions of The Highways Act 1980 those of private residency should also be subject to compulsory installation of a dropped kerb entrance; whether it be Council provided or independent contractor.


These amended terms would ensure that local authority owned land is maintained in the vicinity and all residents of Camperdown, regardless of their terms of residency are treated equally under The Highways Act 1980.
