The 5 nano-gram per se bill, SB 117, dismantles certain basic tenets of our criminal justice system, including guilt beyond a reasonable doubt, the presumption of innocence, and the right to a jury trial. This is particularly troubling given that Dr. Jan Ramaekers, a leading international expert on impaired driving, testified to the Marijuana DUID Workgroup that a person can have 5 nanograms in their blood and not be impaired. Here is an excerpt from his workgroup testimony: Question (Workgroup): Please confirm you said if there was one level where you would agree everyone is impaired, you would suggest . . . 15 ng/ml whole blood, correct? Answer (Ramaekers): Yes, correct. In other words, a person can have up to 15 nanograms of THC in their blood and not be impaired. How can we do away with the presumption of innocence and proof beyond a reasonable doubt if the leading researcher in the world agrees that 5 nano-grams does not mean impairment? SB 117 would criminalize the innocent, and take away the freedom of Colorado citizens. Please vote “no” on this unnecessary, unscientific, and unfair bill.
