Stonewalled Votting irregularity Stonewall Manor HOA Atlanta Ga 30349
There has been much discussion regarding the violation of the voting
procedures as stated in our Association Covenants and By-Laws. Our
concerns relate to the following facts :
1.Homeowners did not receive a letter by Mail informing them of
impending voting and submission of bios for candidates prior to January
13th . The email sent out to some homeowners does not suffice or take
the place of proper mailing procedures for voting.
2.The letter by mail that homeowners received on January 13, 2013
indicated a due date for submission of bios as "January 13" which is the
same date of receipt of the letter.Voting began January 15th prior to
an opportunity for additional candidate names and bios to be
submitted.
3.Online voting does not take the place of proxy voting by mail; and if
so what is the process to transition proxy to on line voting?
4. The online voting procedure was not agreed to by residents and the
procedure has not been presented for discussion or approval by residents
as outlined by covenants and by-laws.How can we be sure how the
online votes are being processed.
5. There is no established procedure to ensure only one vote per lot is
allowed as required by Covenants and By-Laws. How can this be verified?
6.How is the information given verified by the voting company.
Verification of voting results and information provided to voting
company has not been outlined or agreed upon by residents.
7. Residents have not given consent for information to be provided to a
voting company. Giving out information of homeowners to any company
without the expressed written consent is unlawful.
WE, THE UNITED HOMEOWNERS OF STONEWALL MANOR SUBDIVISION REQUEST THAT
THE VOTING FOR HOA OFFICERS BE CANCELLED DUE TO VIOLATION OF STONEWALL
MANOR HOA BY-LAWS AND COVENANTS. WE REQUEST THAT THE PROCEDURE BE
RESTRUCTURED IN ACCORDANCE WITH THE HOA BY-LAWS AND COVENANTS. WE
REQUEST THAT ANY CHANGES TO THE VOTING PROCEDURE BE PRESENTED TO AND
ACCEPTED BY HOME OWNER SIN ACCORD WITH ESTABLISHED GUIDE LINES FOR CHANGE
OF BY-LAWS AND COVENANTS AS STATED IN HOMEOWNER ASSOCIATION COVENANTS
AND BY LAWS.
