This case (No.12-35160) is before the Court of Appeals for the Ninth Circuit, the United States is Defendant- Appellee. It is the cause of China Authority installed bug in the America consulate in Shanghai and was discovered by America. China had not only admitted guilt, also convicted two Chinese students who helped Americans to find bug. They were accused supporting enemy. President Reagan fought it out, but as a result of China cover the case at all, no way to get enough evidence, President Reagan had to give up. It happened in 1983. One of the parties is Mr. Fan.

In 1994, Fan finally left evil prison in China. He always believes America and he didn’t do anything wrong in this case, the wrong is China Authority. The sovereign of the consulate belongs to America and checking bug is the proper and lawful for America. So he struggled to investigate the truth of case, for him for his friends and also for America. For that he should go to the United States, but Clinton Government refused his visa requirement. Fan bypassed Hong Kong in 1997 and finally came to the United States.

In America Mr. Fan had to face countless difficulties, the biggest one is no direct documentary evidence the United States involved with. The Sino- US relation is very important everyone knows, any American Government wouldn’t run risk to break it without reason and evidence. But it’s too much when the U.S. governments refused to answer Fan’s question as he had been a U.S. citizen. Fortunately in 2009 Fan finally got a copy of China's official document which the Reagan Administration wanted but failed, it has proved that the United States is one of the parties of the case, in other way, the criminal and defendant of the China judicial authorities.

Of course it is huge insult for the United States honor. Although the case occurred in almost thirty years ago, the great America could not swallow the insult. The right way is our government negotiates China government, forcing China to admit mistake, this is the Reagan administration wanted to do and didn’t do. However, when Obama government learned all this, they didn’t do anything but keeping silence. It seems they are not Americans. The only explanation is that Mr. Obama afraid of the China, because China is now America's No.1 creditor.

This case is processing in the appeals court. Before that the Federal Court in Washington has dismissed Fan’s complaint under pressure. (No.11-00718-RSM,USDC,W.D. Washington). But the judge did a good deed as he affirmed that “all of the facts alleged by Plaintiff are true.”  Fan had to sue the United States because Obama government has refused to stick up for the honor and rights of the United States.

The Sino- US relation is very important, but the premise is that China should comply with the international rules without running amok and fraud. If actually China regards America as enemy why America wouldn’t fight back?
