    Comments: I am elderly and I have a friend whose children are abusing him financially and I am going to help him fight his family and if he needs an attorney he will get one to protect his property from his children who are trying to get him to let them live in his house and deed the house to him, which he will not do but under pressure from his family he may just sign a deed granting them title to his real estate and I, as his friend will not let that happen.

    Comments: My father was a victim of financial and physical abuse - but the DA has not pressed charges - although there is a lot of evidence showing the abuse (Financial and Medical records scream for justice). The court's tentative verdict states that both siblings involve are guilty of "undue influence, fraud and elder abuse." But fails to apply the penalties of law. LASC: BP099211. This judge also divorced my parents from the grave. My mother is still living and was legally married to my father at the time of his death. The judge choose to ignore the evidence that they were still seeing each other in the 1970's although living apart. We thought that if you are in Probate Court, Probate laws applies. This was not the case. There were so many mistakes made in our case until having the court rule in our favor (I am the conservator for my Mother - she is 94 now) is almost of no consequence. My siblings have already taken all the monies in the bank right before they put our father in the rest home broke ($235,000 and then some not accounted for). Dad had ulcers that were in 3rd and 4th degree stages. No one seem to care.

    Comments: I have personally dealt with two different elder financial abuse situations with my father who was 92 when things started. I live almost three hours drive away and was not the legal Trustee yet nor had the Power of Attorney for finances and property. As a result of discovering the two different attempts by 1) a caregiver and 2) a tenant also contractor, my father went through the dementia diagnosis process which proved positive for. Prior to the diagnosis got the Durable Power of Attorney for finances/property and then after the diagnosis got my father to resign as Trustee. All this avoids any need for conservator for my father. I was then able to take other legal action such as evicting the tenant/contractor, dealing with the Contractor's State License Board, getting my father's taxes done, trust administration, hearing for a restraining order for the caregiver(long story) and now to approaching the end of a civil lawsuit against the former tenant/contractor(long story).
