Name: Anonymous on Jun 16, 2011US State: LouisianaComments: Financial Abuse stemming from conservatorship, guardianship, and interdiction will continue as long as these unconstitutional laws are allowed to remain on the books. And it must be noted that you do not have to be a senior citizen to be a victim of these laws. There are a growing number of American Citizens of all ages falling victim to financial abuse via these laws. It has been said that these are “good laws” that are being misused by miscreants. While it is true that these laws are used to pilfer our life time of work; there is absolutely nothing “good” about any law that allows for our Inalienable Constitutional Rights to be taken away from us as we have committed no crime. And, in fact, a person who has been sentenced to a conservatorship has no or limited legal status and therefore has no protection under any law designed to protect a person’s civil rights. Other than the death sentence, there is no other sentence that is more harsh or devastating than a sentence to a conservatorship, guardianship, or interdiction. Although in many cases a sentence to one of these laws has resulted in the death of the conservatorship victim. The worst criminal in prison has more Civil Rights and protection of their Rights than the person who has never committed a crime and is suffering a conservatorship. The criminal is protected from what is tantamount to legal identity theft and no one dare touch their assets. No amount of additional regulation of these laws will work…the safeguards already in place are ignored by corrupt officers of the court. There are many less harsh alternatives to the laws of conservatorship, guardianship, and interdiction. But the judges of these cases do not guarantee these options although they are honor bound by law to ensure that ALL alternative avenues are exhausted before enforcing the most extreme measure of giving a person’s Inalienable Constitutional Rights away. Since there are many and viable alternatives to these laws, it is not necessary nor in our “Best Interest” to be forced by a court to have our Rights removed at the discretion of a judge. But if a judge could not take our rights away, then there would be no way to obtain our assets, i.e. legal identity theft. Therefore these laws will remain on the books and miscreants will continue to destroy our lives for their personal profit. At present and in respect to President Obama’s Regulatory Reform, our politicians have the opportunity to abolish these laws and thus the regulatory procedures associated with them. But as a victim of these laws, I have personal knowledge of the power and influence wielded by the judiciary and the rampant “good ol’ boy” environment of collusion in which many of our elected representatives reside. So I have little faith left in any branch of the government and do not expect a rush to protect our Rights and property by those who have a vested interest in keeping these laws in place. With this said, annual purple lights on the White House will look nice and a new stamp will be fine for collectors. And I support anything that will alert the public to this travesty of justice. But more…MUCH MORE…pressure must be placed on those who will otherwise pander to the public but actually do nothing to rectify the underlying disease…unconstitutional laws and the loss of our Inalienable Constitutional Rights.Flag

Passing the Elder Justice Act was the first step. Now we need to get it funded and move forward. Our country and its seniors can't afford to continue to lose billions of dollars a year through the financial exploitation of its most vulnerable citizens. Act now.Flag

Name: Jane Branson on Jun 16, 2011US State: OhioComments: For the past four years I have been trying to free my 92 year old Mother, Mollie Florkey, HIllsboro Ohio from an abusive guardian that the court has allowed to imprison in a facility where she has been kept isolated from family, friends and spiritual associations.Only the guardians immediate family is allowed to see Mother, a despicable crime of torture for my Mother to endure in her last years.. I was finally able to get Mother's case in the Court of Appeals from the lower court that has been bias, prejudice and has intentionally withheld Mother's rights, even when evidence was presented that the "Void" P.O.A. that nominated the guardian was unlawful, which was my claim against the guardian. The unlawful P.O.A. stole Mother's life, her Rights, her dignity and freedom. Crimes have been committed against my Mother and myself by the guardian but the Hillsboro court continues to turn their back on an innocent victim.. Mother and I are without counsel and as "Next-Best-Friend Standing and Mother's legal advocate it is my right to pursue an actuion on behalf of my Mother, but the court of common pleas dismissed my case stating, I had no standing when in fact the court knew I did, as Next-Best-Friend/daughter standing. Govenor John Kasich and attorney General Mike DeWine need to immediately take action and Free my Mother before the worse happens. FOUR YEARS OF MY MOTHER BEING IN A PRISON IS LONG ENOUGH !Pictures of my Mother's abuse and tape recordings of Mothers abuse at the nursing facility in Hillsboro Ohio is available for officials to confirm the crimes against my Mother. But most importantly is the clear evidence of the P.O.A. Mother signed when medical records prove she was not competent when she signed the P.O.A. document and the guardian knew it. If action is not taken immediately I fear the worse for my Mother who has been a victim of a horriable crime.Mother's beautiful home, property and all assets stolen by someone she trusted. I want to Thank Mickey Rooney for having the courage to come forward and STOP ELDER ABUSE IN AMERICA ! Jane Branson daughter of Mollie Florkey cwaltershillsboro@yahoo.comFlag

Name: Maritza Torrent - Viola on Jun 17, 2011US State: FloridaComments: I am from the State of Florida where my mother Estela Torrent Mental Heath Case no. 02-1941 (03) and Companion file 02-3204 (03) under the Administrative Judge Maria M. Korvick was placed under an unnecessary guardianship. My mother was appointed a professional guardian ( for the person ) and someone who had been a practing atty. BUT who was in a PSY. DISSABILITY and unable to practice law - (against Fl. Statute ) guardian of her property- who by Fl. Statute had to secure attys. all which were paid from my mother's "assests" her home and personal belongings. Mother was severly abuse and neglected- she lost her sight, and financially explotated, as she did not want nor needed to be under guardianship. I had asked the judge to be app. mother's guardian, I was denied my right, as her daughter willing and able as Fl. Statute, was made to visit mother under supervised visitations for which I had to pay for, under a set schedule -- once there were NO more assests,- the sale of her home - mother was deemed an indigent, and I was consequently app. her legal guardian. there is lots more to this nightmare! please contact me for on similar petitions. I will be happy to help any why I can, IT seems that Animals have more rights when abuse, that citizens of this country...Flag

Name: Diane Wilson on Jun 18, 2011US State: New YorkComments: My mother is currently under the guardianship of Mary Giordano, of Franchina and Giordano Garden City, NY. the judge is Joel Asarch. This situation has been going on for 2 1/2 years. Mom has been treated like a prisoner in her own home, locked up in an assisted living facility and not allowed phone calls or visits from anyone. After 30 days of calls and letters and complaints she was finally released. The guardian charged her account $53,000 for the stay at the Bristal in Massapequa, NY. The list goes on and on. Currently she is locked up in White Oaks Nursing Home in Woodbury NY. This is human trafficking of the elderly for money. It's disgusting.Flag
