Madoff & co Must be set free………!!!!!!!!!!!!!!!!!! Madoff should stay out of jail pending the commencement of trial of all the big shots that were involved in his scheme and the financial melt down of 2008, wall street and bank moguls as well. This is the only way the state can have the pressure to prosecute all of them. if not what explanation will they give to the people for not having madoff in jail. Keeping Madoff & co( other private investors and their associates) in jail is similar to killing Galileo when he said the world was round and everyone was wrong that it was flat. In short we are doing the wrong thing. The system is a free market, no fix prices, no control no guidelines. President Obama at Kansas 2011 on the financial meltdown. “Regulators who were supposed to warn us about the dangers of all this, but looked the other way or didn’t have the authority to look at all.” On 60minutes 12/04/11, Eileen Foster, senior executive of fraud investigation of country wide, one of the epic centers of the crisis, a third of their mortgage loans ended in foreclosures. She says they are lots of people of country wide who belong behind bars and is willing to give the names to a grand jury if asked. Talked of how loan officers forged statements and signatures etc. by cut and paste. And how some colleagues started hiding fraud issues from her and when she had to meet with government regulators, she was dismissed before the due date. And I guess other watchdogs of wall street corporations have similar testimonies like lady Foster. When she was asked by Michael Buble why they were not prosecuted she said she did not know. Therefore the mandatory presence of watchdogs by the law in financial institution is a window dressing issue to create public calmness and confidence. Because the truth is if guidelines are implemented, “socialism” sets in. They know better. So why deceive the public. On 60minutes 12/11/11 when Steve Kroft told President Obama that more people think his administration favors wall street than the common person could be because there has been no criminal prosecutions against those in wall streets and even civil charges brought forward had been dropped. The President made it clear to him that, “that was the decision of the justice department and we keep those things separate, so that there's no political influence on decisions made by professional prosecutors.” Most probably it is wrong to prosecute them because they worked under the guideline of a “free market.” Madoff and co as well. Then The President said they had to change the law and have put into place the toughest law since FDR and the great depression. And that law is not yet fully implemented. But already they are telling banks that if they take risk and fail the Gov’t will not bail them out. And that they have figured out, how to break it up without harming the rest of the economy if wall street gets into such a mess in the future. So at this juncture it is quite clear that those who designed the fraud schemes and their participants will go free. So why is Madoff & co in jail when the others are out?. Madoff & co also worked within the same guidelines of a “free market”. Why were they charged with fraud? Because they were vulnerable private investors who could not withstand public pressure and angry victims and were not protected by the walls of big corporations. Otherwise they too would still have maintained their jobs and sitting on all that we saw he “swindled” from investors. It is morally wrong to attain closure only by preying on the most vulnerable. We should not condoned with stuff like stricter regulations have been put into place and bla bla bla. In that case Madoff and co should also be set free and this will give us a clear insight of how much those Bank guys and wall street guys went away with and are free men and women in the society. Not too long ago, former mayor Ed Koch of New York said that he could not imagine someone will sit behind bars because he stole a bicycle whereas none of those in wall street that participated in the 2008 financial meltdown is in jail . I “sympathized” with all the victims of Madoff and co., Banks, and wall street corporations. In as much as setting Madoff free is hurtful, setting Bernie free pending whatever decision is out there to indict and prosecute their Banks and wall street counterparts involved in the 2008 financial meltdown is beyond Justice. It is more of resolving an issue. Yes Madoff confessed to the son to have been running a “Ponzi Scheme”. Anyone carrying out such financial operations without implementing guidelines in a “free market” must find himself/herself in that situation. One cannot be doing the right thing when all the others are doing it wrong by setting the bar low and attracting all the customers. Sooner or later the right guy will get out of business. Where were all the SEC fraud investigators all those years if this was not the way business had to be done? Even Madoff himself expected arrest after each of their numerous checks he was never arrested. There are people who ensure that the president stays within guidelines not that he is allowed to use his discretion to stay within guidelines so as to avoid a “Ghedaffi America.” So Madoff and co are victims of a chaotic system and not criminals. If the crime is intentional why don’t they abscorn to a faraway land with the money rather than to wait for their fate with the money. If Madoff & co are still in jail before the president leaves office in 2012 or 2016 he should have all of these guys on his list of clemency since he too clearly knows the “crime” was committed at a time regulations were frail or absent. And my advice to all private investors is to quit business or get into a big financial institutions.
